Complex case timeline

Hi, just wondering anyone experienced or is experiencing or knows about timelines of Complex cases, can you please share?
Hopefully we can find out what we are expecting ahead... Thank you!

Myself: Case received by IRCC: Nov 2018, AOR: Feb 2019. Then nothing...
My case is Complex because when the case was submitted, I as sponsor did not meet Residency Obligation.
I submitted a PR card renewal case in Oct 2019, with explanation for my RO issue. The case was approved in Feb 2020 (according to IRCC call centre), then due to Covid, the case was finally closed in November 2020, with the PR card mailed to my address, also with a letter via email confirming that I am in compliance to be issued a PR card.
I have ordered GCMS notes for a couple of times, the last one was received in March 2021, but just seeing sponsorship eligibility to be determined...
Is there any other element that they would evaluate for a sponsor? Or it's just not turning to my case yet...


Really appreciate if any one in this forum had experienced similar situation can share what the timeline could be like...

Is there any other element that they would evaluate for a sponsor? Or it's just not turning to my case yet...

Your situation is very unique. I don't think any of us will be able to tell you want to expect.

It's possible IRCC may decide to move the existing application forward. It's also possible they may refuse the application and you may need to reapply. By the rules, the sponsor needs to qualify at the time the application is submitted. Based on the info you've provided above, the sponsor did not qualify at the time the application was submitted and only qualified as a sponsor afterwards. It's a complete dice roll what IRCC will do.

It's worth considering whether the existing application should be withdrawn and resubmitted. Assuming the sponsor has remained in Canada since.

But I have no info on what might be the best course of action.

Your situation is very unique. I don't think any of us will be able to tell you want to expect.

It's possible IRCC may decide to move the existing application forward. It's also possible they may refuse the application and you may need to reapply. Thank you scylla. I am even prepared to be refused... time is my real concern... don't know how long they can hang a case like this, or how soon do they normally refuse a case

Longest processing time for a family application would be 10+ years. Parent / grandparent sponsorship applications used to routinely take this long around 10 years ago.

It's honestly really hard to say. Your case is extremely unusual.

You can get your gcms notes and see, of course.

Longest? Very long and/or refused. Don't know that this is really the point here.

You did not meet the requirements to sponsor at the time you submitted your application since you did not meet the obligation of residence. That means your file will be refused. In some cases people check the box in sponsorship form that they want to pursuit the application even they don't meet the requirements, then IRCC works on; but even after 3 or 4 years of processing, the file will be refused for sure.

The main thing is to be eligible to sponsor at the time you submit the application. You wasn't!!!

The best thing to do is to withdraw the current application, then submit another one afterwards. If not, you will waste your time for a refusal. Take that as an advice, not an obligation.

1- The key point is ability to sponsor ( Spouse, wife,parents, children).
You failed the ability to sponsor at the submission time. No matter what you do, you will be refused.

A lot of people do that when they realize they do not meet the requirements. Withdraw and resubmit which a gain of time instead of waiting for a long refusal.

You did not meet the requirements to sponsor at the time you submitted your application since you did not meet the obligation of residence. That means your file will be refused.
I don't know for certain* that it will be refused but the very long timeframe between the original submission and now and still no sponsor approval received indicates something's up.

Perhaps the relatively recent resolution of the RO situation with a new PR card means it will move. Don't know. Also don't know if inquiring through MP could possibly help.

But it may be cleaner and more simple to withdraw and re-apply. That decision may have to be taken based on what (if anything) useful can be gleaned from the GCMS notes. And other issues such as the status of the spouse and the type of submission that's been done (i.e. would withdrawing the existing app be a problem for the applicant).

Or as @scylla noted, it's a unique situation - a dice roll and no clear way to know.

As a side note, if the sponsor has been in Canada all this time, and if the counting of physical days in Canada was not suspended (which I think would only happen if there was notification of a formal report? - also not certain what process this went through), it would seem to me the sponsor may now be able to apply for citizenship.

*I'm not disagreeing with @frange's points overall - I think it's clear it could be refused on the technical point of the application having been submitted when not in compliance with RO. I just don't know for a fact that it will be refused on that basis.
