hI,

i would like to ask for an advice, I am currently holding an expired visa from temporary foreign worker permit, i called cic and informed me it's still on process. I am in a relationship with a married guy last 2010 and we have a 2 year old son, our realtionship is continous up to now but we just decided to stay together for the last 4 months.
My question is, can he apply me as a common law partner with my status here in Canada?
iS it possible that we can apply for a common law even if he's not divorce yet with his wife.
Can you pleAse help us.
 
Have you physically lived together for at least one full year and can you prove it?

you have to proved to them that you lived together physically for at least continuously 12 months. and you must have proof like joint bank account, same billing adresses or any joint property.
 
That is the problem, even if were together since 2010 and have a kid we didn't physically live together, we just decided to be together since January of 2016 but then he is not divorce yet, is there any way that he can apply me as a common law?

No - he can't sponsor you as common law.

You aren't common law. You won't be common law until you have lived together continuously for at least one full year. It doesn't matter that you have a child together.

I'm just a bit nervous because my work permit expired and up to this time i don't have any idea what is happening. I'm worried that i might be sent back to the philippines and never see him again.
