Hi, everyone!
Me and my boyfriend have been dating for more than 2.5 years. We have been living together almost the whole time. Want to apply for the common law relationship but the problem is that my tourist visa expired in august 2008! In 2007 I applied for tourist visa - unsuccessfully. In the beginning of 2008 visas between Slovakia and Canada were cancelled so we decided to come immediately (April 2008). The immigration officer almost sent me home but after 5hrs she let me in for 2 months with few conditions. I applied for the extension and could stay until august 31st 2008. Our plan was to wait until my boyfriend gets his citizenship which he was waiting for. He'll be getting it really soon and than we want to go back to Slovakia and apply from outside of Canada. Do you think there's a chance of getting the CL accepted even if I overstayed my visa for almost 2 years? Should we even bother? Is there any other solution for us?

I'm new to all this stuff myself but from what i've read i think you should be okay. The spousal policy allows spouses or commom-law partners to become permanent residents even if they are "out of status" -ie. you overstayed your visa. You can even apply to become a permanent resident while you are both in canada. You do not need to have a current visa to apply as a common-law partner.

thanks a lot. You really made my day! :) I hope we'll have some luck w/ our application. We want to leave anyways because I haven't seen my family for two years. So we'll apply from outside.
Anyone else has any tips or tricks for filling the application?
