Common Law Work Permit under Partner Study Visa

Hi there,

I am currently working with my PGWP, about to expire in apr/15. My common-law, is currently working with an open work permit visa, issued under my PGWP.

I am applying to BC PNP through my company, who is giving me full support and helping me through the process, which will be submitted this Friday (Dec 5, 2014).

Unfortunately, the BC PNP won't process in time for me before my PGWP expiration date, which would obligate me and the partner to stop working, until PNP processes and I can then submit. I would have to either go back to my country, or take a forced vacation till that happen.

To buy time, I am thinking about enrol her into some education here in BC, most likely BCIT, so she could have her study permit, and I could apply under her study permit for an open work permit.

My question is regarding that: BCIT part time courses allow her to have a study visa? If she is under part time courses, would I be able to apply for a new work permit, while I wait for the PNP process? I know some part time courses at BCIT have the same "weigh" as full time, or would she need a full time course for the strategy to work.

I appreciate all help and guidance here. I know some people will probably think on me getting the LMIA, so she wouldn't have to apply, but, I am afraid the LMIA might also not get processed in time before apr/15. Any note here too helps!

You won't qualify for a work permit if she's only studying part time. Her studies need to be full time and greater than six months in length.

Thank you scylla,

I asked about the part times, because a few people I spoke with regarding those courses at BCIT, sometimes, get study permits issued under full time. I guess is the credit/hours involved. Exception perhaps?

So, following up on your answer, there is also terms on institutions that may provide that? Or any college/university full time course will provide me with the wp under her study permit.

I know that is not true for the PGWP, which only a few institutions are allowed to actually provide that.
