My girlfriend is under the impression that I can apply for permanent residency via common law spousal sponsorship. I've been living with her in Canada for over a year on temporary resident visitor visas. She's legally separated but not divorced yet for various reasons. Am I eligible to apply for spousal sponsorship or do we have to wait for her to be divorced?

You are eligible now through common law. No, you don't have to wait for her to be officially divorced.
