Common law sponsorship

My common law and I have been together for over a year and we are now expecting our 1st child together within a month. We have all proof for cic that we've been living together for a year. However, he was sponsored in 2012 via marriage but is now legally separated for 2 years.

Is it ok for him to still sponsor me now?

A sponsored spouse who received PR status has a 5 year period that must pass before he/she is able to sponsor a different spouse.

New Libral Govt delete this rule.Which is under pipeline.
So they hv to wait upto amendment.

Thank u. What do u mean it's up to ammendment? You said liberal government deleted the rule so it's ok for him to sponsor me?

No they didn't, it wasn't even discussed. You're thinking of conditional PR rule.

All PRs must wait 5 years before sponsoring a new spouse, if they were previously sponsored as a spouse to Canada. So in this case they must wait until 2017, or exactly 5 years from when he landed as a PR.

Oh ok. What other options do I have then? I applied for refugee but was rejected 6 months ago..I appealed but still was denied and I don't want to get a removal order

Usually there is a 1 year ban after a failed refugee app before you can apply under a H&C app. However if you have a child that would be negatively affected by your removal from Canada, the ban does not apply and you can apply for a H&C app immediately. So this is what you should probably do right after your child is born.
