Hello!

I'm starting to prep my application to sponsor my soon-to-be common law partner. I'm wondering when I am eligible to submit my application.
We started living together under one roof in September 2019, am I allowed to submit my application prior to that, or I must hit that 1-year mark in order to submit?

Thank you.

No - you can't. You can't submit until after you have hit the 1 year. If you submit early, you're guaranteeing yourself a refusal.

Thank you for your response Scylla.
My partner and I went on a trip in November 2019, and she is in the process of extending her visa to that time.

If the extension does not allow her to stay past September, how is it possible for her to stay here when I apply?

She needs to continue to extend her status.

Do you have solid common-law proofs from day 1 of cohabitation?

We are gathering it now. I'm not sure how "strong" the proof is, but we'll try our best.
I thought visitor visa extension is up to the maximum of 1 year.

Your evidence needs to be solid and prove the full year of cohabitation. What do you have?

If you don't show solid proof of a minimum of 365 days of cohabitation, you don't qualify as common-law and will be refused.

There is no max.

Thank you all for your answers.

On the 1344 application, I am to provide my "current marital status".
I will be submitting this application as soon as we meet our 1-year cohabitation period (in Sept). My question is would I fill in this field as "common-law"? Or is there some official proceeding required to enter into common-law status?

Thank you!!!!
