Hello,

I am just wondering if I would have condition 51 or not? As I believe we are 50/50... as there are some other requirements apart from the one below.

Condition 51 applies to spouses, common-law or conjugal partners in a relationship of two years or less with their sponsor and who have no children in common with their sponsor at the time they submit their sponsorship application.

We met in 2010

I have lived with my girlfriend since January 2012, no kids

Application + OWP was received at the CIC on March 2014.

AOR Received in August.

You will have "Condition 51" as you only become Common-law after the end of the first year of living together, not the beginning. Therefore, less than 2 years before your application was submitted. See http://www.cic.gc.ca/english/resources/manuals/bulletins/2012/ob480.asp#sec02.3

You have officially became common law in Jan 2013 thus since it has been less than 2 years of being common law when you submitted your PR application in March 2014 and have no kids, you would get condition 51.

Had you applied after Jan 2015, you would not get conditional 51, assuming no kids before then.

You should most definitely have Condition 51, since you had NOT been Common-Law for 2 years on the day that CIC received your application. You only had 1 year and ~ 2 months.

So how I got 00 None as condition when we moved in together sept 2011, were apart August- December 2012, together December 2012 to January 2014? I assumed they didn't care about the cohabitation break, but still it would only round up a total of 2 years and 4 months of living together.

Mistake from their side?

did you legally file for tax purposes as commonlaw partners for both of those years?

No. Accidentally added on my partners CRA that it started December 27th 2012, instead of December 27th 2013. So, never filed taxes as common law until I was back in Sweden early 2014.
 
Another person I know didnt get Condition 51 and they were not living together for 2 years before hand, it seems a bit hit and miss.

If they didn't get condition 51, they got very lucky. They should have went out and bought lottery tickets.

Even with the 2012 and 2013 Inland threads, I don't think I have seen any of them state they ever had Condition 51 after the Interview..

Really? I wonder if I would still be lucky with a lotto ticket, we got our CoRP over a week ago. No condition on our CoRP. Although, we couldn't care less if it was there or not. It makes me wonder about all the people who bitch about it...

Not every 2012 / 2013 inland applicants will get condition 51. I am sure some of them have kids and or married / common law longer than 2 years when they submitted their application.

If my wife submitted the PR application after the 2 year conditional PR went into effect, it wouldn't have affected her anyway. We would meet the 2 exemptions. 1. Longer than 2 years married and 2. Have kids together.

Yeah, you are so much better than everybody else for not caring.

People don't feel like they are lucky because it means they can leave their partner as soon as they get there. They are simply curious.
 
Yeah exactly, like there is NO Information out there unless you really look for it. The CORP letter is another one which I really dont have any clue what is it until I really get it.

They expect you to apply and then they just expect you to wait
