Common law PR application worries

Hi,

I'm soon to be approaching at the end of this month the date to which myself and my Canadian girl friend have been living together for a year. And have been getting the required documents in place to be sent off with the common law PR application, my medical, both UK and Canada police certificates, 8 photos, girl friends option c print out, photo copy of her passport, completion of the forms etc.

With the proof of the common law relationship and us living together l'm worried that we don't have enough evidence. We spent the past year living in her mothers house so don't have any regular monthly bills in our name just the odd bill or things like our driving licences showing us at the same address and payslips though l only started working last November so only have slips from November to June not the entire year.

Since June we have had a mortgage along with life insurance together on another house, but due to loosing my job when my IEC work permit ran out and bad advise from a immigration lawyer with regards to me falsely having implied status, we have been forced to rent the property out.

Additional evidence l have is photos of the two of us together, flights from when l first flew to start living with her in Canada, flights from when we both went to the UK to visit my family back in April, join bank account in both our names, phone/facebook message history, letters of support from her parents and a friend who is in the local government stating our relationship is genuine and that we have lived together for the past year.

Any advice if this would be good enough for the application or what else l could do with be great, l feel at the moment it just not enough proof to prove a solid 12 months living together as common law partners.

Thanks, Alex

Hi Alex,

Congratulations on the approaching 1 year cohabitation - I am in a similar boat myself. I have similar information so I would not think that sounds too bad. Do your bank statements also prove that you have resided at your gf's mum's address?

I also photocopied my passport stamps to go with the plane tickets - probably tickets are okay though better have more?

Your gf's mother can also write a Statutory Declaration where she states that you have lived together, though you will need a Commission of Oath to witness and sign that. Example below.

Best of luck!
====================

STATUTORY DECLARATION
PROVINCE OF ______, CANADA

In the matter of the relationship between ____ and ____

I, __name__ of _address___do solemnly declare as follows:

1. That the common-law relationship between ____, and her partner, ____, is known to me.

2. That said relationship is genuine and continuing.

3. That they have cohabited ________________________.

And I make this solemn declaration conscientiously believing it to be true and knowing that it is of the same force and effect as if made under oath.

Sounds like lots of proofs to me. Yes definitely get an official/certified lease agreement from her mom, even if you didn't pay any rent. As well if any mail was delivered to each of you at the address dating back to when the cohabitation started, that would help.

Also there is no Canadian police check required. Guide clearly says you only need police checks for countries other than Canada.

And make sure medical is the very last thing done before submitting the app, since they are valid for 1 year and you don't want it expiring during processing.

I assume you are applying OUTLAND via the London office.

Thanks for the advice,

Sorry l should of mentioned l,m living in Canada but will be applying outland to the London office.

I've got bank statements and payslips that prove i have been residing at the address and have now got a lease agreement from her mother along with statutory declaration. But the issue l have now is that is even from November is looking sketchy now which l believed we would of had solid proof of cohabitation from, my girl friend gave me all of her pay slips and credit card bills for the past 12 months this weekend but l have now noticed along with her driving licence they all have the wrong house number that she never updated!
