hiii folks,

proofs of relationship for common law partner such as photos bank accounts and mails for the same address, do they all have to submitted when you submit the application for permanent resident or visa officer would ask later on for them?

Once you have your ITA, you will have a separate section for your spouse or common law partner and all their information to fill in there. That also includes any documentation you have that proves that you are common law. So you have to show that you meet the requirements for common law, since you dont have a marriage licence to show. Having lived together for a minimum of 365 days, shared expenses, ....

As a general rule, i would try to submit an application that is as complete as it can be because you dont want to have your processing delayed by a bunch of requests later on, nevermind running the risk that your application might even be rejected as incomplete if you missed something important.

Which documents did you submit?

What I have right now ready to be submitted:
- Lease agreement (prof that we've been living together 1.5+ years)
- We applied together for our tax returns this year as common-law
- Last 2 times that we applied for our visa/permit renewals we said that we are in common-law relationship.
- travel history for 5-6 years (the same visas at the same time and the same counties)
- Thousands of photos from different places/counties

Do you think this would be enough? Or should I add smth else?

This is overkill. You need the statutory declaration, plus a few documents (no need for the photos), i.e. the lease agreement, maybe one other document would be enough.

What about the start date of common-law relationship? What should be in here?
The day when we actually started together or a year after?

It's clearly written that it should be the day when we started living together, but I saw that some people discussed opposite. so i got confused

Follow the directions. You become common-law after one year, but if they ask when you started to live together, then provide that info. If you're talking about the statutory declaration, then provide the date you started to live together.

Hello. I am currently a PR and planning to apply for a Canadian Citizenship. Living and in a relationship with someone for more than 3 years but because we are both not comfortable (culture we both have from our country of origin) to declare our common law partnership, we have not gone through the formal declaration process. Now with my citizenship application, I am incline to declare I am in a common law partnership. How should I go through this? I looked on the application form and have not seen anything asking about marital status. A friend of mine advised me to declare as he said I can be asked to submit documents involving lease agreements in our apartment which indicated both of our names. Thanks in advance for any advice. Hi

There is no formal common-law declaration. It is a de facto status; once you have continuously cohabited for a year, you are common-law. If you or your partner have listed yourself as single in any IRCC applicaton after becoming common-law, you committed misrepresentation. If the citizenship app asks for your marital status and you say single, you will be committing misrepresentation. Also note that if you have been filing taxes as single, you have committed tax fraud.

When did you become common-law? When did you become a PR? What was your partner's status when you became a PR?

Hi,

I just need some insights regarding my situation. My common law partner is legally married to somebody else but has not yet commenced annulment proceedings. Also, i heard about some common law PR application being denied because the legally married partner has not filed for annulment yet. In our case he does not intend to file it soon, only when we eventually and hopefully get to Canada. How do we strengthen our proof of common law? Does the joint bank account have to exist for 12 months at least? We are renting an apartment but the utilities are under the name of our landlady. Thank you in advance for your time.
