Common law partner open work permit

Hi All,

Is it possible for my common-law partner to get an open work permit based on my study visa. I did not declare a common-law partner when I applied for my study permit[/b] (I did not know about it as at the time of my application) but now, I found out what it is all about and that I have the necessary documents to prove that.
Anyone with advice on how to go about this? Your comments and suggestions are highly appreciated. Thanks

You can try - but it may be difficult to be approved since you didn't declare your common law partner in your study permit application. When you apply, you will need to provide strong proof that you have lived together for a minimum of one full year and meet the common law definition. You'll want to provide evidence like joint lease, joint utility bills, joint bank accounts and credit cards, etc.

Thanks Scylla, but a bit confused with a statement here, "you have lived together for a minimum of one full year". I thought this condition is not mandatory, you can meet the other requirements but if for any reason (not personal choice) you were not able to live together, it will still be accepted. Please clarify me on this if you know. thanks

Living together is mandatory to be considered common law. CIC will only consider you common law if you have lived together continuously for at least one full year and can prove it. If you haven't lived together - you're not common law. No exceptions.

My common law is studying in canada and I live in Germany (noncitizen), and of course we are both iranian. She didn’t declare a common-law partner when she applied for her study permit, Because we didn’t know about Common-law open work permit.
2 years ago we lived together in Iran for 18 month and we have our joint leas. Now I wanna apply from Germany for open work visa based her study permit.
I want to know your opinions how much I have chance to get the open work permit. And does anyone have any suggestions for additional necessary documents to have a better prove?

2. The Application for the SA that she signed also asks for if you are c/law and she would have to fill out the common/law statutory declaration.
3. So close to a nil chance of getting a SOWP.

We don’t break in this time, I have the flight tickets that I visit her in Iran and she has also the flight tickets that she visit me here in Germany and I can add to them our messages and calls.

No - it doesn't work that way. You'll have to apply, provide strong evidence you are common law and hope you are approved.
