common-law partner : chance of getting a visa

Hi guys !

We plan to move to Canada (my partner and I) next year, but I have a little question : he will be able to have an International Student visa, and I would like to apply for the common-law partner one.

I have a few questions:
-We have lived together during more than a year, unfortunately I had to move to another country recently, and I would like to know if I'll be able to apply even if we did a "break" during a long period ?
-Is it easy to get a working visa for the partner ?
-Does The fact that we are gay change anything ?
-Is it better if we are married ?

Canada does not case a different on sexual orientation so that is fine.
Common law partner requires a addition form IMM 5409
If you can answer all the question fine that common-law is acceptable.
As for the work permit you must verify that you have stronger ties outside of Canada than inside meaning assets and family outside. Considering your partner is joining you need to be more diligent and have stronger ties outside as they think you may not leave. Include travel history of visit in which you did not overstay is helpful.4
