Common Law - Open Work Permit

Hi Everyone,

My bf and I have been together for 2 years in Canada but he had to leave the country because his status expired. I am still here because I have a NOC A job. My Permanent Residency application is in process and I did not declare being in common law relationship in my application. I recently received my BOWP.

My question is that, if my bf wants to come back and if he applies for an open work permit based on my BOWP by declaring our common law in his application, will my PR application get rejected based on misrepresentation of information?

You need to add your boyfriend as a common law partner to your application as soon as possible. Right now you're committing misrepresentation by not declaring him. If you fail to declare him, you'll never be able to sponsor him and you may have your own PR status revoked. Do this first before you try for the work permit. If you try for the work permit first - I think you'll be creating problems for yourself.

Thank you for the information. I just need to make sure whether my application can get into trouble if I declare it now because it wasn't declared at the time of application and VO may consider it misrepresentation at this stage? It's not really a change in situation, so I will have to edit my entire profile and not just submit a new form.

Kind of confused if this is really the best option or should we seek other solutions for him to come back. Please let me know if you have any suggestions. Thanks
