I am an international student. My girlfriend hhas been with me here in Canada since 15th November 2017, when she entered the country on her working holiday. Her permit is going to expire on 14th November 2018, and for her country it is not renewable. When we mark the 12 consecutive months of Cohabitation (15 Nov 2018)we want her to apply for a work permit as the common-law partner of an international student. We have proof of living together, we own a car together and have a joint bank account. Her current employer is willing to take her back with the new permit.
My question is: in order to do the common law declaration we have to wait until 15 nov, but her permit ends on the 14. Will it be a problem if she overstays a few days, just to get the paperwork together in order to apply? she will pay for the restoration fee for her work permit . Do you think it is a viable option?
The initial plan was for her to extend her stay as a visitor and then apply for common law WP. But processing times are 85 days and the we will also have to wait for the second application to go through, and she cant stay without a job for too long.
By reading the forum it doesnt seem to be so dreadful to overstay just for a few days, especially if you apply straight away for restoration.
