Hello everyone,

I hope somebody can give me an advice. my common law partner and I are currently working in the Middle East wherein 2 marriages are being recognized. When we decided to live together, we are obliged to have a marriage contract by our land lord. since his previous marriage is not yet annulled, he can't marry me yet. someone introduces us to a guy and he will arrange our marriage contract ofcourse we need to pay him- meaning it is a fake muslim marriage contract. to our surprise, this marriage contract's record has been forwarded to the Phils. Now my question is, which date shall I put in our statutory form application. there was a question on how many years that we are in a common law relationship. is it the fake marriage date or the actual date that we live together. I will be very grateful to whomsoever who will reply to my query.

If I understand your situation correctly:
Two marriages are legally valid if the individuals are Muslims.

The marriage contract you have entered into is fake and the document/marriage contract is a fraudulent document. This implies it has no legal status and does not have any legal validity. Further, as the previous marriage of your partner has not been legally dissolved through annulment or divorce, this second marriage vide this fake marriage contract would make it seem like your partner is bigamous (If his religion and/or culture does not allow multiple marriages).

In fact, if you choose to use this document in your sponsorship application, you would effectively be committing misrepresentation which could likely result in a 5-years ban from entering Canada.

You must enter the date when you started living with your partner, and not the date of this "marriage contract".

Also, I'm guessing that similar legalities exist as per the Law in most countries. This means you must apply in an appropriate court of law to get this fake marriage contract declared as null and void even though it does not have any legal status

thank you for your advice. this is the reason that we will apply as common law instead of married couple. I will explain everything in my LOE. do you think it can be a reason to refused our application? i'm very worried about this.

You will need to include several evidence to prove you are common-law. You'll be fine

Hello again Bryanna,

I would like to seek for your advice again.
If I'm the main applicant and my accompanying dependents are my common law partner and our 2 kids, is it necessary that we submit our documents together for visa application?
My common law partner's ex wife is not cooperating, she supposed to sign a letter saying that they are not living together for a long time - 11 yrs. (affidavit of their legal separation) but she refused to do that. how can we proceed with the process? shall i submit my application papers with the kids without him? will there be any problem with that? pls enlighten me. thanks again
