Hi Team!

I have couple question about my LMIA application.

I am currently working for an employer on PGWP. My employer is filing for an LMIA application for PR application, but it seems to be taking time, and I will lose my PGWP status in this 3 months process, therefor, my employer has agreed to apply for a closed work permit in order for me to keep working.

Does my employer has to apply for a dual intention LMIA, and pay $1000?

Since I am on LMIA exempt PGWP work permit, and already working for them for more than 6 months. They are not hiring me from beginning, they are just helping me extend my work permit, so ESDC, and IRCC gets enough time to process my LMIA and PR application respectively.

Can my employer not directly submit my job offer on employment portal along with the compliance fee of $230 without having LMIA approved? and submit the LMIA application for PR only? or Is it mandatory for apply for dual intention LMIA then apply for closed work permit?

Dual intent LMIA is mandatory to get a closed work permit approved. Your employer will need to advertise your job as part of this process and complete all LMIA formalities and yes, pay the $1000 fee. You are quite short on time unfortunately.

The dual intention LMIA is mandatory for a closed work permit. The reason why the LMIA for PR doesn't cost the $1000 is that it cannot be used for a closed work permit.

Be aware that the LMIA for the closed work permit will still take a while to process - a few months is common.

Yes it is bit clear, we have already started the advertising process to meet LMIA formalities.

Once we have received dual intention positive LMIA, do an employer still has to pay for employer compliance fee of $230?

or I can directly apply for work permit as soon as I have this document?

Yes I am little bit short by time, however, I also saw on the CIC website that if WP is expiring in less than 2 weeks, and I have submitted complete LMIA application, then I can still apply for closed work permit if I have proof of LMIA application was sent to ESDC, Canada, right?

and then finally send IRCC an approved LMIA document within 2 months. Am I correct?

Is it possible to apply WP without LMIA being approved but after submitting it to ESDC?
