Claim +10 potins with job that is exempt from the LMIA requirement

May be someone is in the same situation...

I get 63 points (not eligible )but......+10 theoretically having this situation:


You currently work in Canada in a job that is exempt from the LMIA requirement under:

an international agreement (such as, the North America Free Trade Agreement) or
a federal-provincial agreement.
Your work permit is valid both when you apply and when the visa is issued (or you are authorized to work in Canada without a permit when your visa is issued).
and

Your current employer has made a permanent job offer based on you being accepted as a skilled worker. +10




If I submit my profile I get ineligible ,somehow system is not counting those 10 points..filling the application, I have open work permit so I dont have any NOC in my current work permit...if I say I dont have job offer why do they give thjis option to claim +10???

EE has slightly different rules, I don't know why it's not working for you...

As well, you said in an earlier post (and again above, if I understand correctly) that you indicated that you DON'T have a job offer. So why would you get credit for having a job offer if you say you don't? What am I not understanding?

Yes, I read that. But why did you indicate in your application that you did NOT have an offer?

If I say yes, after they ask NOC in current work permit, and I have open work permit,what should I indicate there?
In work experience, I indicate my current job is in Canada in Skill B, and also work permit required but no LMIA.

So, I don tknow..for the rest I have 3.5year experience outside Canada, minimun language requeriments and founds...

you have to specify a NOC no matter what is on your work permit. And make sure your canadian experience is at least one year specifically in that NOC category.

without it, does not matter the total points, you simply do not met the main requirements.

If you are on an OWP you won't have a NOC on your work permit, I'm in the same situation and called CIC. They didn't really know why there wasn't an option to specify no NOC, but advised I just put the NOC of my current role.

Just received clarification from when I emailed CIC regarding the lack of NOC codes on Open Work Permits:

Under the Intended Work in Canada section, candidates who indicate they are currently working in Canada are also asked for the four digit National Occupational Classification code on their current work permit. Not all candidates working in Canada (such as those on post-graduate open work permits) will have a National Occupational Classification code on their work permit. These candidates should identify the National Occupational Classification code of the work they are currently doing in Canada.
