Hello Guys,
I just joined the forum . I am a civil engineer my qualification and work as bridge Engineer in USA on H1 B visa. I was looking to apply under category 1. But all they have is Construction Manager that does not match my job. Are strictly the 38 occupation listed in Ministrial list are category 1 and the rest on the NOC come under Category 2 and 3?

I want to know if someone in Civil Engineering has gone through the same thing. My profession is in NOC list but not in the 38 occupation listed in Ministrial list. So does that mean I can only apply under Category 2 or 3

Please help.

Thanks and Regards
Sagar

Hi,

I am a Civil Engineer too, eventhough I applied under old rules, my NOC is Construction Manager as a House Developer (I have been approved), even if you do not have the title of CM but if you have most of the duties under that NOC, you can apply. Best wishes.

Thanks for your reply.

I checked the responsibilities under the NOC that applies to Construction manager. They do not match with my job experience so far. The Best NOC match is 2131, which is not on the Ministrial list.

Please advice.

Can also apply through Quebec or Provincial Nominee. I'm a Civil Engineer too but I'm applying through Quebec.

Thanks for the reply. So if I apply through Quebec I would not have to have a job offer from a company in Quebec?

For Quebec, you'd have to learn french. Good luck.

As a civil engineer you can not apply under cat. 1 because your job is not on the list of 38. If you have a job offer (AEO) you can apply under cat. 2. If you are already in Canada on a work permit or student visa for 12 months or more, you can apply under cat. 3.

If you have a job offer (AEO) you may be able to apply for PR under PNP in the province where your AEO is from. If you are on H1B visa in the US, you may be able to apply under AB H1B program if your occupation is on the AB occupations under pressure list.

Failing that, you can try QSW. Do their self assessment at http://www.form.services.micc.gouv.qc.ca/epi/index.jsp?languageCode=en to see if you qualify.

Every possible job is in the NOC. Even fast food worker has a NOC. To apply under cat. 1, your job has to be on the list of 38. If you improve your French knowledge, you will have a better chance on passing the QC evaluation.

I am sure you must have undertaken some sort of management practice within civil/construction. Log an application and give it a try, you may well succeed. I'm saying this cuz I have applied under NOC 0711 and it has been pre-approved. Even though academically I don't have an engineering background but since I work in project management on large oil & gas projects, I do fit under Construction Management NOC. Good luck.

Sagar Adi, the above is a good advice. Application to Sydney is almost zero cost because if you fail, your money is returned albeit couple months later. If you fail at the visa office stage due to your job, then your cost is the cost of PCC, postage, notarizing costs, etc. Again, depending on where you live, this might not be much. I took the chance where my job title and the job on the 38 list are quite different but I argued that my responsibilities are similar. Sydney approved it. I am at the visa office stage so i might still be rejected but the cost is low for the benefit it might provide if i am accepted. If you are rejected, don't be disheartened though. I believe there is no disadvantage to being rejected vis a vis future application.
