Dear All,

I am a Canadian and US citizen that has resided in California for the last 13 years and I have no intention to return in the near future. I have 2 children (ages 3 and 2) that were born in California but I would like to seek Canadian citizenship for them. Can we apply or do they have to be residents of Canada? I understand that the 1,095 days does not apply to them because they are under 18 but can they be living outside of Canada and be granted Canadian citizenship based on their parent being one? Thanks in advance.

Did you or their other parent get Canadian citizenship by being born or naturalized in Canada? If yes then they are automatically Citizens - apply to the nearest Canadian visa post for their Certificates of Canadian Citizenship.

As long as at least one parent gained Canadian citizenship by being born in Canada or by immigrating to Canada (even if you immigrated as a child with your parents), your kids would be citizens automatically. You would apply for proof of citizenship, see here: http://www.cic.gc.ca/english/citizenship/proof-how.asp

If you gained citizenship by heritage, that is being born outside Canada to a parent who was already Canadian when you were born (same situation as your kids), your kids would not be citizens automatically and you would have to start by sponsororing them for PR status. In order to do that, you would have to show plans that you will be moving to Canada when they get it.
