Citizenship for baby born outside Canada

Hia everyone!

My question is if our baby is allowed to have the canadian citizenship even though he´s not born in Canada? I am from germany and my to-be-husband is canadian since birth. Our son was born one year ago in Germany and has the german citizenship. The german offices told uas that he´s not allowed to have the canadian citizenship. We entered Canada 3 weeks after his birth last year and nobody really could give us answer here. And the more we read about it the more we are curious about if its right? We are applying in the next time for my permanent stay in canada and the next question will be if we have to apply for our son as well? I have a daughter from a previous relationship. I have the legal rights (german courthouse papers)to decide her stay so will it be very hard to apply for her as well?

1. As the father was a Canadian citizen at the time of child's birth he can apply for a proof of citizenship for the child. Also can apply for a limited validity passport if he is under 2.
2. You should note that if the child assumes Canadian citizenship he can lose his German citizenship. Contact the German citizenship, as I believe that he will have 5 years to make a decision after the age of 18 if he wishes to maintain his German citizenship, he will have to renounce his Canadian citizenship.
3. There is also Beibehaltungsgenehmigung That will be possible if he applies before his 21st birthday to also keep his Ger­man citizenship. This is the so-called Beibehaltungsgenehmigung (permission to re­tain your second citizenship). You may maintain your other nationality if it is not possible to waive it, or if there are exceptional grounds for a multiple citizenship.
4. She is included as your dependent on the application. The son is NOT included on the application only shown on the IMM 5406

German citizenship is not really a topic on this Canadian immigration forum but as long as you are a German citizen, your son is allowed to hold dual citizenship with the German. If you are however not a German citizen and your son gained German citizenship only on the basis of you being a German permanent resident and having lived in Germany for 8 years, then he will lose his German citizenship at the age of 23 unless he applies to retain it, proving that he holds no other citizenship at that time.

As long as your husband is either born in Canada or immigrated to Canada, he can apply for the citizenship card for the child, see http://www.cic.gc.ca/english/citizenship/proof.asp

If he was not born in Canada and gained his citizenship through heritage because his parents were Canadian at the time of his birth, he can not pass on citizenship but he could sponsor her for PR.
