CIT - 0520 : Request for Documentary Evidence of Residence in Canada

Dear All and PMM,

I received RQ form last year and I have replied with all the necessary document last year in 2014. Recently I have received CIT-0520 asking me to provide the color copy of my passport as well as translated entry/exits . They also request "Original signed letter issued to you by U.S.A. authorities/U.S. Consulate with respect to your immigration status in the United States of America". The reason I believe I received this because I traveled a lot to USA and I had included all my day trips in RQ form.

I contacted US embassy and they told me that they can not provide with such a letter therefore they advised me to contact to U.S. Customs Border Protection (CPB). I am confused now as who should provide me with such a letter?

I wish I could help with your question, but it isn't obvious to me that a U.S. agency would be willing to write a letter stating your immigration status (or lack thereof). I can tell you that making a FOIA request won't work. Such a request is for *existing* records, not the creation of a new record (i.e. a letter). There may well be records that you could ask for that would indicate your immigration status (such as an I-94), but they wouldn't be in the form of a signed letter. Thank you Alphazip and SCsquare,

I had my I-20 from 2005-2012. After that I had a USA visitor visa for the period of 10 years
because I am permanent resident. I keep travelling couple of times a year to USA and
i should have I-94 records for sure. Asking I-94 records is not going to be a letter, do you
think Embassy can give me in the letter form? I will call USCIS for sure.

SCsquare, they did not ask me for my travel history instead they asked me for my
USA immigration status because I believe mine is also overlapping since I was a F1 Student
and now I possess visitor B1/B2 visa. Your case you had H1-B visa and you asked your employer,
but my case I currently have only B1/B2 visitor visa and previously I was F1 visa, who should I ask the embassy or USCIS??

Or should I contact my previous US university International office confirming that I am not a student anymore??


I am confused maybe because of particular case?

you may have to do a bit more research

1) Get your current I-94 number from the i-94 site... print that letter out.
2) Get your travel history on that i-94 to prove that for you have only used that I-94 for current travels
3) Get letters from your school in USA which had held your F1 visa.. Get the current status of that visa. (This will prove that you currently have one valid visa for USA)
4) Get the current status of you B1/B2 visa. (This will prove that you currently have one valid visa for USA)

5) Write an explanation letter for periods when each visa was held and when they expired.

Thank you very much for the information. I gathered the items 1)- 2) already. I will need
to contact my university for the letter stating that my F1 already expired.

Now what about the item 4) B1/B2 current status?? is it from Embassy or other agency?

Another questions for item 2) getting the travel history using i-94 is enough??, because
I was most of my trips to USA is by car, those entry/exit is not shown in I-94 report? Most of my trips are day trips
which I had to include in my RQ report.
what should I do now? Should I contact US customs border protection about this information??
I have already contacted CSBA to get the report ?? Since they do not ask for that why should I get them anyways??

Although I have no experience with I-94s (I'm a U.S. citizen), if you had to go into secondary when you crossed the border into the U.S., there is a record kept of what the agent typed into the computer. This would likely contain info on your status (unless they choose to redact it), and can be ordered as part of a FOIA request. (See "Information Regarding Entry and Exit" here: http://www.cbp.gov/site-policy-notices/foia/records) However, while simple entry records can be supplied in 40 days or so, FOIA requests for other information can take a year or more to receive.

The FOIA would take more than 30 days and for CIT0520 you need to reply between 30 days.

I already gathered the information (e.g. travel history and I-94 current information) from the link you provided. I contacted my university for a letter stating my F1/I-20 status and the expiration date. Also, I contacted US embassy again, they told me they can not provide me a letter regarding my current B1/B2 visa status, they advised me to contact CBP for that. I also called USCIS for my current B1B2 visa status to provide me a letter but they advised to contact USCIS in Canada ???
The only thing I think i will be missing the current B1/B2 visa status, because Embassy, CBP and USCIS are not providing then who should I contact ???

Try entering your B1/B2 visa number. I know for my H1-B I had an I-797 receipt letter which has my EAC****** number on it. I had entered that number. CHeck on on visa if you have a WAC or an EAC number on it.

Yes printing out I-94 form from (CBP) website is considered as an official document. No you do not need to contact embassy or USCIS.

However,

and entered my Application ID or Case Number when I applied for USA B1/B2 visa

Just printing this will be enough to show that I have received my Visa?? because B1/B2 visa is already in my passport, I think there are more interested in my F1 status correct?

Yes. They would be more interested in what visa do you currently hold for USA.

You need to proof that the old visa expired. and you currently only have one valid visa for USA.
