Document requirements

For the applicant’s current country of residence, the police certificate must have been issued no more than six months before the submission of the e-application.
For countries in which the applicant no longer resides, the police certificate must have been issued after the departure date of the last time the client resided in that country for more than six months.
Police certificates are required up front and are mandatory for each country (except Canada) where an individual has lived for a total of six months or more. This instruction is for the purpose of the completeness check. However, it is always at an officer’s discretion to request a new or additional police certificate.
Some countries require that the applicant complete a consent form to initiate a police certificate. The form is then uploaded (with any other police certificates the applicant may provide) as part of the e-application. If the application is not rejected as incomplete, the processing office will assess the consent form and electronic file and initiate the police certificate.
In exceptional circumstances, IRCC may accept

proof of having requested a police certificate for such countries; and
an explanation of best efforts (not a guarantee of acceptance). The applicant should explain the delay in a document and upload the document. The uploaded document must show that the applicant requested a police certificate as soon as possible after receiving their Invitation to Apply.

What is the updated instruction, is it the above text?

FBI is taking 12-15 weeks to issue a police clearance certificate, is there any solution for this, Will CIC give chance to update that after 60 day period?

That's a significant change (the part I highlight above). It used to be consecutive 6 months or more stay, IIRC.

Yes, Thats the crucial part and a big change too.

Yes.
They gave me 60 days. What we did is that I applied the 1st business day after the invite. I scanned the fingerprint cards and the reciept of the post office. I also applied for PCC from the state. (My husband also applied for FBI check through channeller, but he was in the states at the time. If you are not inside the US, I believe you can't. I am not sure though. However this one is not that important. The most important one is the scans.) Then I wrote a short explanation letter and mentioned that I did not know that FBI check would take so long and I applied as soon as I found out. But it takes 3 to 4 months. I waited as much as possible and then submitted my application. Please give me some time and I will upload it as soon as possible.

After that I waited until the 58th day and uploaded all these materials. In addition, I uploaded the explanation letter in both slots for pcc and explanation letter. As you can see in my signature they gave me 60 days and I submitted it a few days after they requested for it.
Follow this. They give you time.
If you want I can send you my explanation letter as well. It was very short and concise.

Can we get a link to that new information? It's sure not on the public cic police certificates page, that's still the old info.

I'll be off to get a fbi check ordered (as a stopgap)... Also my wife will probably need a Aussie one now... (this non consectutive thing). I feel like I'm flushing money down the toilet though.

The interesting part is that I've never 'lived' in the USA. I've visited alot as my family is from there. The only time I've lived there is when I had a student visa and the time spent in the USA under that visa is not 6 months. it was a 3 month vocational school.

Interesting development.

When did this update happened?

I have already submitted my application and got AOR on Jan 28th. My wife stayed in US for more than six months in total but not in a stretch, so we didn't submit PCC from US for her.

Do I need to apply for FBI PCC?

I did not understand the post. Did you mean you submitted the the application without PCC on the day after you got your ITA, and on the 58th of the 60-day extension they provided, you requested another extension and it was granted. Did I get it right ? Is there an advantage of submitting the application early with the PCC?

retroactive effect (starting January 1st) is very discouraging and frustrating. Do you think a rejection is likely for applicants affected by this change of rule?
