CIC declined Temporary work permit for Post Doctoral Fellowship

I would like to share my really bitter experience with the CIC.

In June 2013, I have applied for a temporary work permit with documents given by The University of British Columbia for a temporary work permit for 1 year. I have submitted my offer letter and also supporting letter stating my job description. I have also submitted a letter from my present University in France stating my status as a PhD student. I have clarified my position in the 'letter of explanation' that I am going to complete my PhD in September 2013 (supported by a letter from my supervisor) in France and then start my PostDoc in UBC. Besides the postdoc, I have stated family reason, as my wife is also going to start her MBA in Vancouver (she already has her offer letter and visa approval) in September 2013. I should mention here that I have a M.Sc. in Materials Science and Engg. from Sweden and at present at the verge of finishing my PhD.

Unfortunately the CIC rejected my application within 24 hours. The reason stated that I have not satisfied the officer that I will come back after my PostDoc. In the followup, I have asked the CIC that what kind of documents they need? which can prove that I will come back after my designated stay. To be honest I have rejected offer from UC Berkeley, so that I can be with my wife in Vancouver. Can anyone give an idea what the hell the CIC wants as a proof of a person's qualification and most importantly intention.

Well it sounds like you get rejected because the CIC could tell your actual intention - I'm not sure why you're bitter. You should be looking into a spousal work permit that may be available to you through your wife's study permit.

First, keep in mind that you're asking for free advice, so posting with an attitude isn't always conducive to getting helpful responses. Secondly, the quality of the responses is based on the amount of information you give in your post. Belittling anyone for not "asking you about your status" isn't going to help.

Any temporary residence application is processed on the assumption that you intend to stay in Canada - i.e. you have to prove the officers wrong. They look for ties to your home country (property, financial assets, family, etc.) - they more ties, the better. With your wife studying in Canada, this just gets more difficult for you. If you own a house in France, then including a copy of the deed will help (or other long-term assets, including cars, etc.).

As I said in my first post, you could potentially be eligible for an open work permit through your wife's study permit (see http://www.cic.gc.ca/english/study/work-spouse.asp) - it will be valid for as long as your wife's study permit is valid. As such, if you can gain your post-doc experience on the work permit, then I'd highly suggest going that route as you won't have to demonstrate as many ties to your home country since it is inherently linked to your wife's status.
