CIC and my 6 months.

I have applied for my immigration WITHIN Canada.
CIC received my completed Immigration package which included the application for an open work permit on March 3rd. ,we have yet to get any acknowledgement of receipt back or Application Number..
I will have been in Canada 6 months around the first part of April.. So I will have to leave and go back to the United States if we don't get my work permit approval before the day I have to leave in April.
Can I do that and come right back into Canada and show the Canadian Border Officers the copies of my Immigration Package as proof I have applied WITHIN CANADA and the we have a home in Canada, so I can get back into Canada. Should I call the Canadian Border Services and just talk to them about my situation and getting allowed back into Canada ????.. They make me nervous lol

My wife who is a Canadian Citizen has to stay in Canada to care for her mother,, Her sister passed away which is why we are back in Canada. The days my wife works I help her mother if she needs me to do anything for her....
I know I don't dare stay 1 day after my 6 month time limit without leaving, I am just worried about getting back in to Canada to be with my wife and our family, and to finish out my PR Immigration ..

Don't know why you think you have to leave. As you applied inland with an OWP, you will have valid Implied Status after you current stay expires until you recieve the OWP.

As OP has stated they entered for 6 months, it's safe to say they are already here as a visitor.

In Canada applications have the expectation that you are remaining in Canada. That's why they afford the applicant the OWP. You exercised that option, you have implied status until they "make a decision" and you receive the OWP.

From: http://www.cic.gc.ca/english/resources/tools/temp/visa/validity/implied.asp :
"
A temporary resident must apply to extend their period of authorized stay before it ends. If they have done so, their period of authorized stay as a temporary resident is extended by law until a decision is made [R183(5)]. Such a person is considered to have implied status as a temporary resident during that period.

If a temporary resident applies for renewal of their work or study permit and their permit expires before a decision is made, paragraph 186(u) and section 189 of the Immigration and Refugee Protection Regulations (IRPR) (the right to continue working or studying under the same conditions pending a determination of their application for renewal) apply only as long as the person remains in Canada.

At some point my wife and I both were given wrong information.. We were told that 6 months is the max I can stay UNLESS I have applied for immigration and that your application has been accepted for processing and that I also applied for my open work permit at the same time and included that OWP application in the completed package that we sent by over night carrier to the CIC in Ontario. This person had also told us the Open Work Permit is what will allow me to stay in Ontario after my 6 months as long as the application package was received in Mississauga Ont and that CIC had issued a Application ID Number AND that the OWP was approved BEFORE the end of my 6 month visit in Ontario Canada... We have never heard the term ""Implied Status" until your response to my post.. You learn new stuff everyday of your life !

So If I am understanding you both. As long as I have mailed in my Immigration Package and APPLIED for a OWP in that package, I Don't need to leave Ontario. I have yet to hear back from CIC, and I DO NOT HAVE A OPEN WORK PERMIT YET I can still stay past my 6 months? WOW SO COOL
OMG YOU both have no idea of the amount of relief you have given my wife and myself for this information. This process has been confusing and stressful for us both. We were thinking when I tried to come back into Canada at the hassles they would give me .. whewww

You can go anywhere in Canada. You are not limited to Ontario either. And yes, you do not need to leave. Because CIC's mail room received the OWP package on March 3, you're under implied status as a visitor until they complete the OWP processing.

"This person" is an idiot. I hope it wasn't a paid immigration consultant or lawyer.

Wow, you've had some misinformation.

Even if you didn't apply inland with the OWP, and instead applied outland (in the past, outland was much faster for Americans) you could just renew your visitor status online. You never have to go to the border. It's something I never recommend you do as the guards are really pissy about people flagpoling to renew their status.

AOR has been taking about a month, so be patient. And the OWP takes about 4 months so don't expect it in April.

I do wonder what you mean when you say "AOR" ??? ...

I agree about the folks down at the border.. I watch to much TV lol so that was making me very nervous about going down there and being able to get back in.. they seem to frown on anyone who is going to Live in Canada.. I am so glad I don't have to worry about that or about leaving at my 6 months,, My wife and I both were freaking out..

I am so glad I posted on here,, I have learned allot from all of you who have replied to my post and WE BOTH thank you all !!.. I also wondered about how to renew visitors status online.. but I don't have a visitor Visa. I have just a Passport,, Everything mostly talks about VISA's again very confusing for us,, so we gave up on that idea...

One more question.. Once I receive my Open Work Permit,, will I be safe to go back to the U.S. and move our household goods to Canada ?? Or will that change my status back to "Visitor" or will I still keep my Implied status ??

You can't import your personal belongings tax-free until your PR has been approved and you have your COPR. If you import your belongings earlier, you'll be paying tax. Additionally, this could create issues re-entering Canada. Leave your stuff in the US until PR is approved.

With my wife being Canadian and its our stuff, couldn't she go down with our Brother-in-law,, who is also Canadian,, and bring our stuff back.. we need our belongs here so we have a place to eat at and sit on and cook with lol and other items.. I kinda thought it would be a bad idea for me to go!!
