Chinese *Outland* spouse sponsorship but German visa office?

Dear all,

I'm the Principle Applicant of an outland spouse sponsorship application, and I'm a Chinese citizen. Although I am in Canada now, I plan to submit my application as outland, because I have a job offer to work in Germany for 6-12 months starting in April or May. But I'm not sure whether it's better to submit the outland application to the Chinese or German visa office.

According to the top thread of this sub-forum: "If your spouse is residing in a country other than the country of their nationality, you can pick which of the two visa offices you want. Otherwise it will be processed in their country of nationality."

My questions are:

1) I don't have a German VISA or work permit yet (still need to apply for one). Can I include my German job offer letter in my application package and use that to justify choosing the German visa office (work place in the near future) to process my outland application instead of a Chinese visa office (country of my nationality)?

2) Does anyone know the current processing time for spouse sponsorship outland application in the Hong Kong visa office OR in the Germany visa office?

You should look first and foremost at the application information that is currently being used, and more recent forum posts and whatnot when you have questions.

I believe the application process has changed since that thread was started and now all outland applications are submitted to Sydney, Nova Scotia. It then _may_ be sent to a visa office abroad but it no longer seems applicants have any control over this or to which one it is sent to.

You may wish to include in your application package a letter of explanation that you expect to be living in Germany, but I don't know if this will have any impact on how they process. It may be that they ignore it until such time as you are living in Germany with documentation. Obviously you could delay submitting application until you are there, but again, not clear if that will change anything.

Important note, I don't believe living in Germany would remove the need to provide whatever China-specific documentation (such as police certificates or whatever else) given that you've been living there until recently so keep in mind getting such docs from China may be difficult while you're in Germany, I don't know.

I welcome input or comments from others, I don't know about the Germany/China aspects.

Will your spouse (the sponsor) be with you or residing in Canada?

Thank you so much! I looked through the first few pages of posts in this sub-forum and also searched for several key words, but couldn't find what I need.

I understand that all documents from China are required no matter where I live. I have those documents ready to submit. I actually haven't lived in China for a long time. My special situation is that despite that I'm a Chinese citizen, since 12 years ago I've always been residing in either Canada or Germany. But I'm not a German permanent resident, either.

My concern is that I don't want to go back to China for medical examination, give biometrics, etc. I would like to do these in the country where I reside, and hence I prefer that the visa centre of Germany to process my application, if possible. Or if no matter which visa centre handles my application, I can go to an assigned institute in Germany to do my medical exam, give biometrics, etc., instead of flying back to China, that'd be great, too.

My spouse (the sponsor) will stay in Canada.

My understanding is that you can do the biometrics and medical almost anywhere in the world. They definitely give a list of authorized medical facilities and you can go to any, including in Canada. I do not know for certain how or where in Canada you can give biometrics, but you can definitely give at any of the authorized visa centres around the world. Perhaps someone else can clarify re biometrics in Canada.

Note in some parts of the world visa centres and authorized medical are not everywhere - for some it does mean significant travel - but it it's not related to which visa office is handling your file or even strictly to country of residence.

Note you may need some docs such as police certificates from other countries you have resided in.

Caveat, this is all to best of my knowledge, please read the docs and app materials to check. Other forum participants may know more than me.

I do not know for certain how or where in Canada you can give biometrics, but you can definitely give at any of the authorized visa centres around the world. Perhaps someone else can clarify re biometrics in Canada.

One more thing that you need to know that CIC has the discretion to decide which VO you should go for an interview, whether it will be in HK or in Germany, if it is requested. You don't have the choice to pick.
That's a good point, no idea how they do this, but hopefully they'd key it off some stated residence/address rather than just nationality.
