Children not living with father

I am filling out an outland application to sponsor my husband. My husband has included his son on the 5406 form. His son does not live with my husband but we have done the medicals so we can sponsor his son in the future. Do we have to put my stepson's information on the Imm 008 ?

If he is a dependent, he needs to be on that form whether or not he's living with you. My oldest is not quite 22, so isn't living at home and doesn't plan to move up here but still needed to be included.

Thank you. Even though his son lives with his ex and she has full custody, his son's information must be added on the section of dependent on Imm 008? Which on box 3 of this form will no longer be one but two as how many family members are included in this application? this can be confusing since on my sponsors form 5481 sponsor's evaluation question 5 I would now have to include his son as current undertaking?

I believe so. You will probably have to also include copies of the custody agreement and divorce information, as well as his birth certificate. There should be a spot on the form that mentions if he will be immigrating now or not.

Yes, the child must be listed on IMM0008, included in question 3 and therefore counted as part of the undertaking.

This is explained in the guide.

IMM0008, question 3 - Indicate the total number of family members included in your application. This includes yourself and any family members, regardless of whether they intend to accompany you to Canada or not

IMM0008, dependent section - You must list all family members in your application for permanent residence, whether they are accompanying you to Canada or not.

My last question regarding this form, after this I can move on. Question 14 on the IMM 008 asks, Where you married or in a common law relationship?

I'm not sure how to answer this one because there is not a law regarding common law in his country and second he did live with the mother of his child for during the the pregancy, approximately 10 months.

Should I include the dates regardless if its less than one year?

If he only lived with her 10 months, then they were never common-law according to CIC so he would answer "no" to the questions about being in previous common-law relationship.
It would only need to be mentioned if they reached 12 continuous months.
