I have grown children in the US that I listed (as requested) on the paperwork. They require they all have medical checks and police certs even if they are not accompanying me. I sent in a notarized letter saying I surrender any right to ever sponsor them in the future. I have no contact with my older 3 since my divorce a while back (they don't like it that I have moved out of the country) and my former husband has all major decision power with my younger two who are almost 18 (but not quite). He won't allow them to get a medical check and I agreed in the divorce settlement that when I visit I will never take them out of the state of GA. I sent in a copy of that too. (I think he was afraid I would take them to Canada and never bring them back so to make him feel more comfortable I agreed.)
Any chance immigration will accept my notarized letter of surrender to sponsor?

Provide a copy of the divorce settlement document to show you agreed to never take them out of the state of GA......and with the notarized letter of surrender to sponsor......IRCC will understand and you should be okay.

Include the custody agreement stating that your former husband has full custody, you only have visitation rights, and a signed statutory declaration stating that you understood that by your children not completing the medical exam they would be forever excluded from family class sponsorship and you would never be able to sponsor the children as PR in Canada.

Thank you for your reply. I also have two older boys (who I listed on the form as instructed) who are under 22 which qualifies them as dependents. Since my divorce, they have moved and I don't have contact info for them. I did list their names and DOB but I also listed them in the notarized letter I wrote which states that I want to surrender my rights to ever sponsor any of my children now or in the future.
I am hoping by including all the children in the letter ages 21 and under and having my letter notarized by an atty that this will suffice. I also had a friend (neutral party) in Texas write a lengthy letter which I attached with my notarized letter. She spelled out the story of my divorce and how my older children have moved and I no longer have contact with them. (their choice not mine)

I am applying as a principal applicant for common law sponsorship permanent residency to Canada.



On my application, I listed my children as instructed. I understand Canadian Immigration requires all of my children to get medical exams and police checks. However, since the breakdown of my marriage and divorce to *************** I have not had contact with my older children and rarely have contact with my younger two all due to their disapproval of the divorce.

I do not have any current contact information for my older children and the two younger children (ages 17 and 15 ) are in the custody of their father. He will not allow them to have a medical exam or police certificate. He is in charge of all major decisions for them per the custody arrangement.

I have attached a portion of the divorce settlement agreement which states that the children are not allowed to leave the state of ********* USA during my visitation. This was agreed upon by both of us so he would be more comfortable since I moved to a foreign country.

With me not having current contact information for my older children and the younger ones being in the custody of their father, I am requesting to waive my right to ever sponser them in the future. I understand this will never be an option.

Please accept this notarized letter as my official agreement to surrender my right to sponsor now, andthe future the following persons:

Please remove their names and DOB. This is a public forum and you have listed your full name and their fathers in conjunction with their middle names. This has identity theft possibility listed all over it. It’s as bad as people leaving their phone numbers and emails on this forum.

Thank you, limonade! I had edited, "tried" to copy and paste but the edited version didn't paste the way I wanted it, and I didn't check after I posted. Thank you for bringing this to my attention. All looks to be good now.

Good you have included all your children (whether in your custody or not) in the letter notarized....you should be okay.

Also, ensure in your application to list all your children (whether in your custody or not, whether accompanying or non-accompanying) in IMM5406 form.

Thank you very much for your comment. I did include all of my children on form IMM 5406..also my parents, brother, and common law partner.
On the Generic Application IMM 0008 I did not list my 34 year old, however, because he is over 22 and married. That was my understanding for that form to just list those 22 and younger. The forms are so confusing. I think I proofread everything so many times that my eyes felt crossed.
I hope they are happy with what I submitted.
