Hi,

Thanks for the reply. I do have legal representation in Canada (for immigration to Canada), but not in the USA (regarding getting access to my children). I have no family in the USA who are willing/able to assist me with this, so I would have to hire a lawyer down there to assist.

I have already started enquiring about a lawyer in the USA, but the ones I have spoken with are asking a $5,000 retainer, which I can not afford.

What I might have to do is continuing working in Canada on a temporary work permit until I can sponsor my husband to immigrate with me to the USA so we can get access to my children and possibly return to Canada at a later date.

So many obstacles!

So many obstacles!

I understand the obstacles......my ex husband died, therefore any custody issues became null and void. Previously, before his death, he consistently made every effort to stop my immigration process for my son.

As much as I never wished for his death, never even thought about it, it did prove to be a blessing when applying for immigration.

Hi everyone,

I received a reply back from my Canadian legal representative yesterday. They advised me to contact the USA court, if possible, to request that my ex comply with my request for immigration medical exams of my three children.

The even better reply they gave me though was that after age 18 my children can choose (to live with me) and I can sponsor my children up until age 22. They didn't seem to think they would have much trouble helping me with this.

That said...I don't think the USA will allow me to bring my children with me out of the USA until after they are 18, which is a long time from now.

I am going to try to stay positive and focused. I have some things I can do while waiting for AIP (which my lawyer said to expect after about 10 months - so in May 2011). I am going to get my name updated (to my married name) on my USA passport. I am going to find a way to petition the USA court regarding the medicals for my children. I am also going to do what I can to prepare my husband's USA file ... just in case.

I really appreciate all of the replies on here. I feel much less alone.
