I divorced 5 years ago and my son lives under his mother's sole custody according to a court resolution. But I received an ITA and now I have a new family and a child who I included as accompanying family members. But CIC keeps asking me about my son which I don't have a custodial right on him or he cannot move anywehere independently until his age of maturity. Once I submited his upfront medical exam taken by panel physician by the request of CIC. Then CIC asked about his passport which he didn't have and his mother doesn't agree him to visit abroad with me. Several times I explained this issues to CIC, but once in 3 -4 months they require different documents of my son from previous marriage. Today, they asked again about upfront medical exam which I uploaded 1.5 years ago. Please help, how should I make sure that they do not give offer to my son living with his mother ?

Allegedly, medical exam expires in a year, so as long as the processing time lingers you or you unaccompanying dependents may be asked to go under medical exam any time. I submitted only National ID card for my son from previous marriage and they accepted it. I explained that his mom does not allow him to go abroad withour her presence.
