Child issues please help!

I hope everyone is fine.

I had applied for PNP and later accepted their nomination. Now, I have also received ITA. I have been married twice having a daughter (aged 9 years now) from my first marriage that resulted in a divorce during 2009. I have 2 kids from my second marriage.

Now the problem. My daughter lives with her mother in my city, but they have not let me meet her for the last 4 years inspite of several attempts. On a no-choice basis, in my PNP and CIC profile, I had mentioned "4" family members (me, wife and 2 kids) instead of "5" (with 3 kids). My ex-wife is not cooperating at all in letting me have my daughter's medical and passport even if she is non-accompanying. My daughter's status is still the same.

Please guide:
1. Is there any way I can include my daughter in my CIC application now?
2. What if the situation changes later in the future and I get custody of my daughter legally? Can I sponsor her?
3. Will my application for PR get rejected if I include her in my CIC application now?
4. My CIC PR application wants to know how many kids I have and their details. What shall I do now?

Please help !

1. You are required to declare your oldest child in the app. Unless you can get her medical done, she will need to eventually be excluded.

2. If she doesn't do the medical and is excluded, you will never be able to sponsor her.

3. It won't be rejected for declaring the child. However, it could be refused and you could be banned from Canada for not declaring the child, as it is misrepresentation.

4. Tell the truth.

1. You need to list her on the Additional Family Information form. You will need to show that you have tried to get the child's medical done, i.e. communication with the mother/family where they refuse. If there is a formal agreement showing you don't have custody, include that. You need to send a notarized declaration stating that have done what you can to get the medical done and that you understand that your child will be forever excluded from the Family Class and you will never be able to sponsor her.

2. Why did you have no choice? Yes, you need to declare her in your app.

3. If you can get the medical done, she can be included as non-accompanying and doesn't need a passport. That will allow you to sponsor her later. This is by far the BEST option. Try to explain to the mother that you can't actually take the child to Canada without her legal permission (show her IMM5604, the form required in such situations) and that the only person she is hurting with her selfish decision is the child.

What was the outcome and what legal document did you provide in pakistan? Did it suffice?
