Hi please help...me and my.husband are both in the Phil since Oct 2017, got pregnant mid of 2018 and not allowed to travel back to Canada because I have a risky pregnancy and just need bed rest for the first trimester, husband decided to stay with me till.i give birth (April 2019), planning to go back supposedly last year but due to pandemic we are scared to leave the baby behind with my parents who are seniors.

Is it possible if we apply for a tourist visa for our baby so we can bring her with us in Canada and then just sponsor her while inside Canada?

1. If you are PRs and have been outside Canada since Oct/17, you have a bigger problem than a TRV for your child.
2. It would appear that you no longer meet your residency obligation of 2 years residency in every 5 year period, as you have been outside Canada for nearly 3.5 years.

Couple of things: you may not be compliant with your Residency Obligations. You may be able to get a tourist visa for your baby and return to Canada, but will not be allowed to sponsor her till you in compliance with you residency obligations.

Days needed is 730 days in Canada _in the last five years_ (as of the date of examination. Therefore as of today only your days from January 2016 will be counted, which is less than 730.

(Note if you were in Canada the full period from Jan 2016 to October 2017, it will take you a longer period of time to become compliant, as you will lose days / add days at the same pace until October 2022.)

If you last lived in Canada in October 2017, then you don't meet the residency requirement. The 730 day residency requirement is a rolling requirement which means you must meet it on an ongoing basis. Since you have been outside of Canada for more than three years, you are in violation of your residency requirement.

It seems you misunderstood how RO works. Let's say you come back to Canada on January 28, 2021, the only days that will count is from January 28, 2016 to January 28, 2021. Since you have been away since October 2017, if you left on October 31,2017, you were only in Canada for 642 days at the most AND this is only if you did not leave Canada at all from January 28, 2016 to October 31, 2017.

Every day you are out lessens the number of days within the past 5 years for you. I agree with everyone else, while you may be able to get a TRV for your child, you are not guaranteed not to be reported when you come back to Canada for violation of your RO obligations. If you are not reported, you cannot sponsor your child until you are compliant with RO.
