I have been following this forum for a while. A relative of mine had applied under the FSW MI1 category and i was guiding them thru the wait and updates. Well, he just got a refusal letter after a 2.5 yr wait. Here are the details:
Sent application to CIO in July 2009, Submitted additional documents around Nov. 2009 to Islamabad, The usual online updates about file being tranfered to London. Then the 'In Process' update in March 2011. On 3/13/2012 it changed to 'we started review etc' than on 3/20/2012 it changed to 'Decision Made' <- that was the 1st indication that something was wrong.
They got a TCS letter with all original documentations back on 4/3/2012. The Letter is from appendix D in the FSW manual OP 6. Pretty much it says "insufficient evidence of you performing the actions described in the NOC's main title and main duties".
My relative has worked in the field for some 10 years now and has been doing pretty much everything that is in the NOC. This seems like a very subjective criteria and the sad part is that it seems to be a final decision of the visa officer.
If there is a way to appeal it please let me know.
