Mississauga, October 26, 2012 — In an ongoing effort to deter people from using marriages of convenience to cheat their way into Canada, Citizenship and Immigration Canada (CIC) introduced a new regulation that requires certain sponsored spouses live in a legitimate relationship with their sponsor for two years or they risk losing their permanent resident status.

“There are countless cases of marriage fraud across the country,” said Citizenship, Immigration and Multiculturalism Minister Jason Kenney. “I have consulted widely with Canadians, and especially with victims of marriage fraud, who have told me clearly that we must take action to stop this abuse of our immigration system. Sometimes the sponsor in Canada is being duped and sometimes it's a commercial transaction. Implementing a two-year conditional permanent residence period will help deter marriage fraud, prevent the callous victimization of innocent Canadians and help us put an end to these scams.”

The new regulations apply to spouses or partners in a relationship of two years or less and who have no children in common with their sponsor at the time they submit their sponsorship application. The spouse or partner must live in a legitimate relationship with their sponsor for two years from the day on which they receive their permanent resident status in Canada. The status of the sponsored spouse or partner may be revoked if they do not remain in the relationship.

Minister Kenney was joined at today's announcement by representatives of Canadians Against Immigration Fraud (CAIF). Sam Benet, President of CAIF stated: “We applaud Minister Kenney for taking bold steps to address the growing problem of marriage fraud and for protecting the integrity of our immigration system.”

“I think it is a very good measure,” added Palwinder Singh Gill, founder of the Canadian Marriage Fraud Victims Society. “Canada's generous family sponsorship program was being abused because many people were marrying only to get a permanent resident card and then leave their partners. With this rule, those abusing the system will think twice.”

i dont see the point ...... just like me my wife and most of other members here on this forum we really do not care if they put a condition for 10 , 15 or even 20 years after applicant gets pr ........ and i think everyone will agree with me when i say we don't care if they just give applicant a visitor visa for 2 or even 3 years and let our partners be with us while they process the application ............ but the answer most of us are really looking for is ...... why is this system keeping us apart for so long to process the application ...... how is the system helping families by keeping 2 individuals that love each other more then anything in this world away from each other ......... and where are all those human rights organizations when husband and wife and in some cases even kids and their parents are kept away from each other ON THE DAY OF EID ........ So true , how can they do that arent they smart enough to find out which case is genuine and which is not. just for 1-2 cases how can they give punishment to everyone really not fair.

I think the answer to your question is that the system is flawed. And seriously man, if somebody was serious about duping the immigration system to come to Canada, what's stopping them from living with their spouses for those 2 years?

Totally agreed... First impression about Canada has been pathetic... they are very incompetent. They try to copy America but total failure. If they want to catch fraud there can be so many effective ways. but their rules are punishing the genuine people and fraud people will still be able to get through. I think even Pakis would have managed it better... I'm disappointed...

Bhai yahan sb ki yehi story ha, hosla rakho, and inshallah this is going to be your last eid away from ur wife. Make this time memorable for your parents and family here, because you never know when you will get to spend eid with them again.

Yeas so true. the legislation that UK and USA did years ago, they are doing that now. This legislation is useless for us now as we have already waited 2 years just to begin our lives together, and that too just becasue of the incompetence of these people.

yesterday my husband received CSQ after 26 days

now expecting AOR from islamabad.

my question is should we email chc-isl and ask for AOR or just wait?

we applied in june, got approval in sept (letter from missisauga with ottawa pilot project stamp on envelop )
and now received CSQ

ecas shows :

We received your application for permanent residence on *******.

Medical results have been received.

is it a good sign ?

Sorry u feel terrible, after reading this msg of u I had to check your previous posts to find out when did your case was started and it was in June 2011.
Just to let you know that their are several applicants waiting from much longer then you and still they have to go through I don't know how much longer and I am one of them. But we are living our day to day life and waiting patiently for a positive result and yes most of us haven't met our spouses from long time. Just a suggestion visit the 2010 thread and then give up.
