Changed Employer, New LMO in progress - Need to travel URGENT

Hi,

I entered Canada as foreign skilled labor in 2011 under service to business management category workpermit. My workpermit expires on Jan 2014 but my department in the company got acquired by someother company so now i am part of new company. As my new company is willing to apply my new LMO under their company name, till that time both company has decided that i will be paid by my previous company.

So in nutshell i am still being paid and on payroll of my previous company till the time new LMO has been approved. I had my vacation planned to go to India before this all happened. My question is can i travel outside the country or not? my assumption is i can as i still have valid work permit with same employer as i am still paid by my original company.

Please advise if any fellow members in this group see any issues with immigration.

If you can get a letter from your employer saying you're going on leave but will go work for them when you come back, then you'd be okay.

There is nothing stopping you from travelling, you don't even need a letter. The only time you can't leave is if you are on implied status. Travelling with an LMO in process if fine. Taking time off from an employer to go home does not require written permission. Who shall you show?

Thanks so much for your reply. I will be carrying my recent paystubs which is from same company on which i have VISA and LMO approved.

One last thing, new LMO in progress will not create any issues right? I dont think i am in implied status as of now as i am still getting paid by my old company. As per my knowledge i cant travel once my LMO is approved from other company as than i need Visa based on new LMO.

Please confirm if my understanding is right.

TRV, WP and LMO are three different things.

LMO is not an immigration document. It is from Service Canada in support of your WP. It does not affect your travel
Work Permit is not a travel document. It is also not a status document. Therefore you can travel in and out of Canada with or without a work permit.
A TRV is an immigration document. It is also a status document. Therefore you cannot and travel in and out of Canada without a valid TRV.

So as long as you have a valid TRV which is multiple entry, you can leave and enter Canada as you please. No need to worry about LMOs or Work Permits.

Thanks for the reply.

I have workpermit visa with multiple entry till 2014, i hope thats what you mean by Temporary resident visa. Sorry for mutiple questions as i am just want to make sure i dont get into any trouble while coming back to canada.

I have been told from my company as Immigration officer may have record of new LMO pending so he may deny the entry. As my visa is with old company, is that possible if will deny the entry due to new LMO or transfer to new company pending.

Please advise, i really appreciate your help as i have to travel urgently as my grand father is ill.

So you are still working for old company. You are still working for this company. Just tell them the situation if they ask. Never lie with CIC. Tell them you are joining a new company when the new LMO is approved but until that time you are still employed by this company.

If your company has immigration knowledge why are you using this forum?
