Change of status for a dependent - what to do to still go in canada

Hello,

I am in a big problem. My husband and I got our visa for Quebec Skilled Worker program. He was the main principal and I was his dependent. After we got the visas, my husband filed for a divorce. I think he has another relation and he want to take his girlfriend with him.

I want to go in canada, but I can't because I'm the dependent and I should land with or after my husband. My husband doesn't want to come with me in canada. What ca I do? what are the options in my case? should i reapply from the beginning as a principal applicant and lose my visa.

Please, can you help me. I feel hopeless. I wanted so much to go in Montreal where my relatives were waiting for me and now with the visa in my passport I can't go because of my husband.

I am looking forward for any reply.

I am sorry to hear that. Are you from a country exempt visa to visit Canada?

You can no longer use the visa. You will have to apply again from the start as a principal applicant.

Hi Sad to hear that. I think you need to apply again best thing you can do to my opinion is email the email them. which country are you from?

You wil need to apply again.........since you have family already in canada why not try the PNP route

If I apply again, it will take many years. I was the dependent, but during the application process I send all my diplomas (bachelor, master) my work experience and everything the same as my husband who was the principal applicant.

If I reapply the process will start from the beginning? Do they have any documents that I can sign as a change of status and keep my visa valid.

I'm sorry but what is PNR route?

If ur hubby informs the visa office of ur marital status now, ur visa wont b valid anymore.PNP is provincial nominee program another way to get into canada.you can read it up on the canada website.

I think he sent an email to the embassy saying that he asked for a divorce. It will take some time though, for the divorce to be official. I am very sad.

I'm sorry to hear about the divorce. If your family status changes, you can no longer be your husband's dependent and thus you would have to apply as a principal applicant for your own visa. Similarly, your husband will no longer be able to count points you may have contributed to the application where he is the principal applicant (up to 5 points for your education and another 5 for having family in Canada) and CIC will reevaluate his case to see whether he still meets the 67 point cut-off on his own. In other words, if you separate, your applications are completely separate. CIC will ask for your CoPRs back and cancel any visas you may have and then reevaluate from there.

Before you return your CoPR, make a photocopy for your records as the number on the too right (your client ID) will not change for future applications and including your UCI on future applications may help CIC realize what they have already verified for your case and thus avoid rechecking bits and pieces of your background and may help them leverage parts of your background check already done.

For your application, there will be a new skilled worker program in January that you can look into. There's some info on the proposed program at http://www.canadavisa.com/canada-immigration-discussion-board/new-fsw-points-criteria-announced-new-federal-skilled-trades-class-fstc-t115576.0.html
There is also the provincial nomination programs to consider. If you can get a job offer with LMO, you can get a work permit to wait out your PR application in Canada.

If you have separated, you need to advise the Canadian visa office before either of you land.

If you are considering your options and trying to reconcile, I would return them once the decision is final (as long as neither of you land before finalizing the decision).

dear can you tell me that how many points your husbands case has secured?
i mean when your docs are updated in it then it means that he fetched your 5 points of spouse.
so get caips for his case if you dont know how many points he has fetched.
if they were 67 points only then it means that he got eligibility cleared on the basis of your points.
if he tells about exclusion of your docs from file then even his case will be not in position to get through.
this is my view point check with other senior members also.
i think you can make a deal with him if this happens.

He took 67 points. I gave him points for my education, my work experience, my age, I have also relatives in Montreal. So from me as a dependent he took many points I think 15.

My problem is If I restart the application from the beginning as a principal this time it will be a long procedure again 3-4 years? I have sent all my documents when I was a dependent should I send them again as a principal?

I tried to convince him but he doesn't want to come..he has his girlfriend now and he doesn't care for canada but I care and I don't know what to do??

I don't know you, but I can clearly tell that you don't deserve this, and your ex-husband is giving you a hard time! After all these years of waiting, when the big moment come he backs down!
