Hello!

I need help all.
I recently broke up with my common law partner. we sent out an application for sponsorship sometime in april of 2013 and we both decided to cancel the application recently. I want to send an application for the canadian experience class instead. I believe i qualify under Noc-2282 - as a technical support consultant. I just have one BIG PROBLEM.
my work permit expired in feb of 2013. i have been in canada on implied status. Do i have to leave the country if i cancel my application for sponsorship or no?? keep in mind that i intend to apply under the Canadian experience class instead.

Once the spousal sponsorship application is cancelled you will no longer be under implied status. So yes - you would need to leave the country. Submitting a CEC application will not restore you rstatus.

Ok thanks. i just though i would still have some implied status since i am reapplying. thanks for your response.

You are only on implied status if you applied for a new WORK PERMIT before the old one expired. (Applying for PR does not affect your work status). If you applied for a new work permit when you submitted your spousal PR application (and it was before the old permit expired), then yes, you would be on implied status; cancelling the spousal PR application would cancel the application for the work permit as well.

So, just to conclude, applying for CEC does not give you a work permit, and would not give you implied status.

But if you are eligible for CEC, it doesn't matter if you apply here in Canada or if you leave and apply from your home country...
