Chances of Rejection of PR travel document application

Hello!!!

Have there been any cases where application for PR Travel document been rejected ? Since I would land in Canada as an immigrant next year, but may have to return to home country within 3 weeks of landing without PR card.

I am just trying to check if there's any risk in applying for PR Travel document for re-entering Canada.

The only reason you would be refused is if you do not meet the residency obligation.

In order to meet the residency obligation, you need to spend 730 days (2 years) in Canada in your first 5 years as a PR or any rolling 5 year period after that.

Since you are not a PR for 5 years yet, they look at if you are still able to comply before the end of your 5 years. Since they only require 2 years in Canada out of 5, that means that you can be outside Canada for up to 1095 days (3 years). It is therefore impossible for someone who has been a PR for less than 3 years to be in breach of the residency requirements yet as they still have time to return to Canada and stay their two years. Therefore, you can not be refused.

Please i need your assitance my case is as follow:
I have a Canadian Permanent Residence. During the last 5 years, I have spent only around 5 months in Canada. (I have not entered Canada in the last 2 years). I am now outside Canada, and my Permanent Residence expires on March, 2013. What is the best method for me to enter Canada while still keeping the Permanent Residence? Would that be traveling directly to a Canadian airport or entering Canada via the American-Canadian borders? Is it better for me to use my old passport that contains my American Visa or issue a new passport that doesn't contain any visas? Please note that my old passport also contains my UAE Residence visa.

I believe that in my case I can apply for an exemption based on humanitarian and compassionate grounds because I have been taking care of my ill mother for the past few years. It is now possible for me to go to Canada because somebody else is available to take care of her.
I need your advise about the subject and, if possible, your service by arranging the draft letters and/or sample reports which support my case because I want to have those documents with me when I arrive to Canada, which is planned to be within two weeks.

It depends on the embassy. In some it can take several weeks. A travel document is usually valid for 6 months so it is ok to apply in advance to when you want to leave.

Some people say that the land border is easier but any busy border is probably good for you because then they will not have much time to spend on you. An old passport with an UAE residency visa that is still valid may attract their attention but a brand new passport with no stamps might too. If they ask you directly if you meet the residency requirements, you should say that you do not but you have humane and compassionate grounds because you were taking care of your sick mother and you are ready to prove this when you apply to renew your PR card.

Most likely they will just let you enter and that's it. You can then stay for 2 years straight at which time you meet the residency requirements again and then apply to renew your PR card without a problem.

If however they decide to report you for not meeting the requirements and this is actually not that common, then you would have to appeal for your PR and prove that your mother was ill and that you were actually taking care of her. If you win your appeal and get to keep your PR, you would still have to complete your 2 years in order to get your PR in good standing again. If you were to leave again after having won your PR back and something happened to your PR card while overseas and you ended up being in the position that you had to apply for a travel document and still did not meet the requirements, you might have a problem.

Since then, I have been following up on my PR Card on the customer care every week.. initially they said they don’t have an update.. n after almost 2 months, they said it’s not been processed at all and they are going to put a query to Sydney office, and they told me to call after a month. I am really confused as to why they need a month just to check. Meanwhile, I have to travel back to Canada in couple of months, so the only option I have now is Travel Document. It’s been around 4 months since we became PR and have been outside Canada. Can you please tell me the documents I would require to justify my case and the residency obligation. Would there be any case of rejection in my case. Also would it be okay if my husband applies for the Travel Document later as he would travelling later this year or early next year.

You should really create a new thread and not open up a 6 year old thread.

Not sure why you are worried about applying for a PRTD given you only landed this year so your residency obligation is not an issue at all and people apply for PRTDs all the time when they have done a soft landing but for whatever reason do not yet have their PR cards.

It will be obvious on the application with the details you need to fill in that you are a recent landed PR so really the only reason for rejection would be not filling the form in correctly.

As for your husband applying for a PRTD later that’s no problem either although preferable if you are in Canada by then for you to mail or courier his PR card to him.

And sorry for opening my issue on this, I just searched for a similar case and thought of putting my concern on this..
We have been in so much tension with this PR card thing, we are not getting any proper update on that. hence I thought of applying for the PRTD.
