It has nothing to do with an application of the brother, each application will be reviewed on individual basis, unless there is a tie of misrepresentation between two cases (applicants) then there might be a problem.

Now I am giving a more clear view. we applied in Family class in 2006 with some misrepresenation about our residence in some particular city guided by some stupid consultant but in reality we never even listened about that city. so in our forms we also mentioned that our other brothers also lived there in that particular period. That application was refused to someother reason and this misrepresentation could not be detected. This refused in 2007.
In the end of 2008, me and all other brothers applied through PNP and we all were alloted different file no. as different nomination letters were issued to us. so continuing the keeping in view that they have our previous record of that misrepresentation, we again misrepresented the same thing to avoid conflict between two application. My brother also did that because I has given this information about him in my previous application in Family Class.
Now situation is that my brother did not ever applied before but he has to misrepresent about that previous situation which I already have given in my application.
I am asking, if they detect that I did it in my previous application and then they refuse it and as the misrepresentation also applies to my brother, can they check in their system that whether his someother brother has also applied or not, to give the fruit of misrepresentation to him too?
I mean during background check, if they come in our area and ask about that, people will say they are living here since brith and never lived in anyother city? do they come in our area to ask people?

I think the focus of an individual's application is on that individual so they will focus your application on you and your brother's application on him if they are two seperate applications.If i understand you well your misrepresentation is wrong address well I've seen a few people get away with this You might be lucky as well.

I am not expert, however I know that visa officer are trained to detect any fraud or misrepresentation. If you did something in your previous application and was refused for some other reasons and you was not caught, they sure will review your past application not to base their decision on that but merely to see that all is aligned. I don't know their process, but it is simple as they would only access your CAIPS notes and will see everything.

I am not sure if your misrepresentation will cause any issues to your brother unless they find a link. The only person will pay the price is who misrepresented, if your brother application has all truth, then he should be fine until and unless they find substantial link with something. I can only guess and the truth is the IO's are very expert and they have access to all kind of data, if they find there is a fraud, they will reject the application.

By the way, I haven't heard that they send people to the applicant residence and asking questions from neighbors etc.. I heard this only happens when they want to verify a marriage they think may be fake to get PR.

do they keep all our previous paper applications and all covering and explanation letters in their record or they destroy paper applications after decision and save the information in computer for any future applications? please answer

Again, this is my best guess - who knows what they keep until someone worked there.

speaking about CAIPS, i dont understand how they will have all the detailed work history or education history of the applicant in CAIPS? any idea how they keep a record of the supporting documentation (employer reference letters, educational certificates, etc...) submitted with the previous applications? do they make a scan of all these documentation and attach them with the applicant's record in CAIPS? or do they only keep such documentation in the paper form? i am asking for the clarification because my understanding is that the only information they have in CAIPS is the information applicant provides on the application forms? please comment and correct me if i am wrong.

The IO makes all their notes about applications in CAIPS as well. They do keep hard copies of documents submitted.

so it is cleared now that they keep hard copy of application forms and supporting documents. can any one confirm that whether they keep hard copies of covering letters or explanation letters also?

Upon receipt of visa, they will return all documents in paper form. I guess, they scan everything for their own file... I'm pretty sure that chances are high if one has already done with his medical, moreso if passport was already submitted. However, not unless you get to see it with your own two eyes did you feel its complete realization that finally a decision has been made. With China Connection, it said that a decision has been made yet he haven't really got back his passport with the visa stamped on it. It took me 4 months for my passport to be requested for visa stamping and yet in the status it said - still in process. I'm hoping that I'll get it pretty soon to save us from all this awkward feeling.

Thanks alot. Exackly my point. My Staus is still "Finalised" but i haven't recieved my passport back. We are in dire need of our passports now. We are afraid to write a mail to them asking when they will send the passports. We also don't want to borrow the passports for that would mean dragging things again. We just don't know what to do at this point. It is 1 month 3 weeks now since they got our passorts and medicals.

Fingers crossed.

Looks like if one can go personally and if possible - get the visa and stamp it the same day. If you are in east coast and have to fly to west coast, its worth it than a painful wait.

Your status sound better than ours. In our case, we have completed our medical rqt's since October, and we haven't heard anything yet till now. Tried to check e-cas, and it says there "in-process". OMG, it's been that way since 3 months ago. Good luck then!
