dear seniors,

one of my friend applied under NOC 4131. he claimed point from his uncle who is on social aid in canada. now my query is-

is there any chance of rejection of his application due his uncle's status?

seniors plz guide me...

Hi,

There was one applicant who applicaation was rejected because of two reason one he applied under NOC4131 and his english was moderate and secondly his uncle was also in Canada but was not doing well financially, so they refused him saying the NOC you applied for requires a good english which you dont have and secondly your uncle is not financially sound.

So its depends how good he has scored in English and how good he is financially. Rest is upto visa officer what he thinks.

in IELTS my friend got 7 in L,R,S and 6.5 in W and he is financially solvent too.

His score is good and as you said financially he is solvent too so i dont think he should be worried, but we should all understand that visa offices are coming bit hard on NOC which are not in the list anymore so it little bit depends on our luck as well. But he should not be worry if they raise any question regarding his uncle he should be able to prove that he is not depending on his uncle financially and he is good enough to make a career in education industry despite english is his not first language.

I am also under NOC 4131 but i am not thinking about these things because there are only few cases where visa officers have raised a question. So Good Luck to him.

I think his language is good enough to fullfill the requirements of 4131, however if your friend wants to claim points from his uncle and this 5 point will effect his final score below or over 67...there may be problems.

I claimed 5 point of My mother in Law who is canadian citizen .She is an old lady and getting welfare fund .Would it affect my case negatively?
 
I dont think an immigration officer would get that much furious on someone like the case of sunasir , rather the officer has every reason to get furious on someone like ddev's case. Someone able to work is on social aid should not be a pleasant story in Canada when its tottering in recession.
 
Hi, One of clauses explains that sponsor cant be on financial aid... so this cae will be declined purely on the basis that Sponsor is not doing well himself and cant afford sponsorship...

I hope your friend is not applying in a Family Class; it just a FSW with few points from relative. If so, there is high chance that his application will get rejected. Here is what instructions says and since his uncle is on social aid it will raise immediate red flag.

The sponsor agrees to sign a contract (the sponsorship undertaking) by which he or she promises to provide, for a specific number of years, coverage of your basic requirements (food, shelter, clothing, fuel, utilities, household supplies, personal requirements, dental care, eye care and other health care not provided by public health care) and those of your family members who will be accompanying you to Canada.

dear experts,

i am new in this forum and, as u can see, this is my 1st posting.

i searched the postings and luckyly the subject matches with what i was looking for.

my asking nearly matches with sunasir

my parents are now living in canada and they are PR there. i claimed points from my father. his age is 62 and both r getting welfare fund. will my app be rejected for that?

my ielts score is r-7, l-7, w-5.5, s-6.5 and at present i have bank balance which is more than cad$ 14,000

There are every chances that Anyone claiming points from someone who is on social aid could be rejected. This is what happened in at least 2 known cases. Canada suffering from the recession and they are not gonna welcome people whos relatives are weak in earning and/or claiming social assistance from the Canadian Government.
