So, after asking to submit our passports VO after one month asked this:

Please submit for principal applicant SlavaSZ
- Copy of original Civil mediation paper for your divorce.
Please submit for dependant SlavaSZ's son who is 17 years old:
- Custody agreement showing who has legal custody of this dependent
Since I had no official marriage with their mother and we parted without any objections to anything including custody of children therefore there was no Civil mediation and custody agreement was oral. As for the son, they had notarized permission to immigrate with me from his mother. So, they need not to worry about who has custody of him. I wrote VO a letter explaining all of it with relevant articles from Family Code of my Country. A few days later got reply, a few days more Decision Made and a few days more passports with visas.
