Certified copies by a foreign notary public

Hi All,

Appreciate any input about this as I'm about to send my application and I'm getting really confused about this topic.

For copies of orginal documents I'm sending ceritified copies by a Spanish (from Spain) notary public. The stamps and text written where he certifies the original and the copy are identical is in Spanish and cannot be in any other language.

1. Even if the document is in English or French, does this certified copy need to be translated because of this?

2. if the above answer is yes, should the sworn translator translate only the text in Spanish or the whole document, even if is already in English?

For translations the guide states the translation needs to be sent together with an affidavit. I'm using a sworn translation form Spain certified which has validity in Canada...

3. is still an affidavit needed? it seems redundant and more over, to get this we would need a notary public which will again certifiy the translation in Spanish...

check this out, it's written in the guide from CIC's site:

Certified true copies

To have a photocopy of a document certified, an authorized person must compare the original document to the photocopy and must print the following on the photocopy:

“I certify that this is a true copy of the original document”,
the name of the original document,
the date of the certification,
his or her name,
his or her official position or title, and
his or her signature.

so what i'm thinking is that what the notary declares needs to be in english/french.. i think it's obvious too because they're not obligated to understand any other language than their own official ones. So find a notary that probably works with a certified translator and get him to declare that in english.

also, they mention that every document that is NOT in english/french needs a legal translated copy + a certified copy in your native language.. so logically i would say that if the document is in english/french, you just need a certified copy. BUT if just parts are in spanish and the rest in english, you still need a translation.

Based on what they say, you need an affidavit. If i were you i prefer sending more stuff than needed rather than having missing documents and getting the app refused.

If document is already in english or french, then it doesn't need to be certified. In most cases just a regular photocopy is fine where you aren't submitting the original.

Does it mean only standard photocopies of passport, marriage certificate, birth certificate... are needed if they come already in English or French? Reading the guide again you can interpret indeed that...As I have already certified copies by a Spanish notary public (with the sworn text in spanish), what would you do still sending standard photocopies, sending the ceritified copies or sending certified and its translation? I'm getting really lost with the documents part.

If a document is already in English or French (i.e. a passport and visa), just a regular copy is ok?

Only translated documents need to have a Notary Public?

Translated documents need to be translated by an certified translator. It makes sense. If you just have your unqualified friend translate it, then how does CIC know that she translated it properly? They could make it say anythung they want, and since CIC doesnt read Spanish, how would they know the translation was all wrong?
