Sorry to hear of your long delay, but unless your application has reached SELDEC01 status or beyond, I'm afraid your application will be cancelled under the new C-38 legislation

It's expected the bill will affect 280,000 pre-Feb-2008 applicants (with around 20,000 as a sufficiently advanced processing stage to avoid cancellation):

Now that the Jobs, Growth and Long-term Prosperity Act (Bill C-38) has become law, CIC will terminate processing Federal Skilled Worker files if applicants:

applied before February 27, 2008, and
have not had a decision made by an immigration officer based on selection criteria before March 29, 2012. (information on selection criteria is below)
CIC expects this will affect around 280,000 people including dependants.

CIC will return fees paid to the Department, without interest, for applications that are eliminated under the provisions in Bill C-38. CIC is currently finalizing the fee return process, which will involve confirming up-to-date contact and payee information.

CIC has set up a central task force based in Ottawa to handle the fee return process. More details will be posted on this website as they become available.

I did case specific enquiry. they did not reply. No one from prefeb applicant group got any reply from NewDelhi for CSE . :-[
Back in 2011 aug, I got std reply which most 2004 applicants got .It did not contain any thing regarding status of application.

I know about the new act. On jan 1 2013 , most of the pre feb cases of ND was DM(without medicals) except half of 2004 applicants who are still in process. My case is inprocess without any news .

All 2004 ND applicants have SELDEC 0 .But these files were reviewed physically by VO in Nov 2012 to check whether SELDEC is 1 in paper files, though it is 0 in electronic files/CAIPS. After that manual verification of SELDEC, ecase of many is DM but a few is left with in process without any clue what could it be??? :'(

Without an update from the visa office it's difficult to say for sure.

There are 300,000 pre-Feb-2008 applications. 280,000 of those will be cancelled, 20,000 will be processed.
Therefore on pure statistics alone you have a 6.6% chance of not being rejected. Or, a 93.4% chance of being rejected.

You have tried emailing the visa office and asking if your application will be amongst those cancelled under the C-38 bill?
