CEC REFUSED due to NOC code

And my take on the reason for the letter being shorter than usual (without the detailed rationale) is that CIC decided to refuse the application from the start and the message was system generated - explanation not necessary, as you failed to meet major eligibility criteria (skilled work experience)!

Also agree with everyone that you should reapply. But if I were you, I would closely monitor what the consultant is doing, so that no other mistakes are made. In this case, I dont think GCMS will do you much good....but, maybe you see some other useful notes from the VO. So, if you are not in a total rush to reapply, get the notes and then adjust your app as necessary.
My bridging work permit expires in june 2014.., so is it okay if wait a while??

GCMS notes take 30 days to process. I would say dont wait too long, but you can definitely wait for those if you wanted to. Dont see the harm...

The sooner you apply, the sooner you get it processed. But considering that there are constraints on how many times you get BOWP (since you are submitting a new application, you should be eligible for another one - your application number will change), you dont need to reapply right this second.

Just my take on it! :)

Okay so i'll be able apply for another BOWP??
i have all my document ready.. And i think i'll be receiving my GCMS by this week hopefully... So i'll take a look at it and then reapply.

OB 485 A is the operational guideline you want to read.

My interepreation of the text contained "The WP is to be valid for the duration of one year from the date of issuance. Subsequent requests from applicants to extend their stay on an open WP will be considered on a case-by-case basis." is that it sets the validity of the permit when issued, but not how many iterations one can have. Meaning, if you have a valid application and you fit all the elibility parameters, you can apply for BOWP.

But, the language is a bit vague, since it does not specify what an extension is. So, you could argue that you are applying for a new BOWP, under elegibility of a new application. My opinion is that it is possible...its just how you position your application.

If you dont feel confident though, then I'd say apply as soon as you can. That way you cut down on some of the wait.

While GCMS notes are helpful, the case is pretty clear cut.

Your BAD consultant made you apply using an NOC that would never be accepted under CEC, as it's skills level C, which isn't eligible. If you can get another application in, with an NOC that best matches your duties, in skills level 0, A or B, then you stand a chance.

In order to get the BOWP you need to at least have received your AOR and your existing work permit must be expiring in the next four months.

I think according to my job duties 1211 matches my job... And the consultant also said that she spoke to cic and and HRSDC And she is pretty confident that i can use 1211.. So hopefully this time he is right.

I'd be having a serious conversation with her though. Why did she allow you to submit an application with an NOC that was never going to be accepted? It was not the required skills level!

How much did you pay?

I'd either be asking for my money back or I'd be requesting that work from this point on is FOC.

Hell, I'd even be questioning the need for a consultant in the first place. To them, all we are is just cash flow....thats it. But if you dont feel confident to do this on you own, then ok. But as JSM put it, I would definitely question the service standard there and note that it was their mistake which resulted in the refusal.

The due diligence should be with their office, since they are filing the paperwork, and not you.

Totally. There is a difference between a small error and a huge one.

If I was a dr who examined you and determined you had chickenpox, when you actually had cancer, is this something any of us would let go? I think not! Malpractice!

She thought that if the immigration officer goes by 2006 i would be okay bcoz according to 2006 it falls under B... And yea i did pay her alot!! Shr didnt do any kind of research on my job duities or anything,,, I was just shocked when i received the refusal and and wasnt thinking straight and paid her again... I was stupid i just started thinking straight and that is why i posted her :( but im going to see het next week and give her a piece of my mind!!! Honestly soo pissed!!

The problem is that these people are not held accountable for their practices, since nowhere in their contracts does it say that they guaranty anything. Sort of an insurance policy if you will - should they make a mistake, one cant come back and say "you told me everything will be alright".

Since you paid her already, I would breathe down her neck. Every document, every communication....every action even, needs to be run by you. And if they say they are busy, than just lay it out....its your fault that we are doing this again. Had you done your job in the first place, we wouldnt be having this conversation.

Yep exactly i call her every single day and she is soo vague and never gives me a straight answer and never lives up to her end!! And im questioning her every move!!

Damn now im scared.......I also applied through a consultant.

However, I know like 3 to 4 people who applied through him and all of them got their PR..........that's why im trusting him so much
