Hi, I have closed work permit till Jul 16, 2016 and have received AOR no. and added my Spouse to my PR Application and paid the fee , i have below questions reg the Open work Permit

1. i dont want to continue with the present employer ,Can i apply for open work permit? i have my closed work permit in inforce till Jul 16 ,2016 If yes which forms i have to fill?


My Wife has dependent Open work permit and she is presently wrking in canada but in different location ,Is there a chance for me to raise the open work permit OR BOWP with the present work permit in Inforce

I don't think you can do that. My spouse was on open work permit too. I had to wait to be within 4 months to apply for BOWP for both of us. They stick to that 4 months rule. When you are within 4 months you can apply. Some ppl say you can apply earlier and when they process it you are in 4 months but nobody is sure.

But if i need to change my job during my PR In process -Is there any other way ???

If you can find a new employer who is willing to apply for an LMIA, you can apply for a new TWP. You can change jobs AFTER you get the new work permit.

you can apply for BOWP for both of you. though its a rule to be within 4 months of existing WP expiry but its not a mandate. while applying you need to put a covering letter and explain that you are applying for BOWP since your current employer doesnot have work/project to assign after 2 months and you want to be in canada until a decision has been made in your application. so to support your family you need BOWP so that you can work for any employer.

I have done this back in july 2014. so confident that you can also be successful.

For what it's worth, I think this is bad advice for the OP, Thota, for 2 reasons -

1) CIC is more strict now on the processing of BOWPs than it was in 2014

2) While it may have been the truth for saja roy to say (or imply) that the job was being terminated, that is NOT true for Thota. Thota simply wants to change jobs.

So what happens if CIC calls the employer to verify that Thota's employment is being terminated? That is (a) misrepresentation, and (b) could really anger the employer (and rightly so).
