Hello friends,

I am in big confusion as far as new CEC Class rules are concern, your advise and information in my case would be highly appreciated.

My post graduate work permit is getting expired in December 1st week of 2012. In case after December 2012 in worst case scenario, I can't extend/reniew my work permit in anyway and have to return back home and in between January 2013 the changes come in CEC class and work experience requirement reduces from 2 year to 1 year. In such situation, Can I take my chances to file for CEC application based on my following profile and assuming new changes would come in effect from january 2013?

Post graduate program in Ontario, Canada: September 2010 to August 2011 ( 2 study semester and 1 Co op work term )

1st Job in Toronto, Ontario: September 2011 to April 2012, Full time as a Bookkeeper and Office administrator, From September 2011 to November 2011. I worked on Off campus work permit, but that was after graduation as my final letter of attendence from my school says I graduated in the month of August 2011 and from December 2011 to April 2012 I worked on my Post graduate work permit.

I did not work in any skilled job during May 2012 while i was on post graduate work permit.

2nd Job in Regina, Saskatchewan: June 2012 to November 2012 as an Accounting Analyst, On post graduate work permit. I am still working in this job but not sure would be able to maintain it after November 2012 as my work permit is expiring.[/b]

Considering above facts, in worst case scenario, Can I take my chances with CEC application as per new rules considering out of 12 months I worked 3 months on Off campus work permit after graduation ?

I am having hard time in Regina as my work permit is expiring in 2 months and seems like all my patience, my hardwork and my efforts are sliping away with the time. My current employer is helping me in Saskatchewan immigration nominee program but to bank on that would be big gamble is province has made it more tougher.

Please advise friends, I need your suggestions as I am running out of hope !

Hey,

From 9/2011-11/2011, you worked while having a "off campus work permit"; according to CIC,

"If you are no longer a full-time student or do not maintain satisfactory academic results, you must return your work permit to a local Citizenship and Immigration Canada office."

Since you graduated in August, I'm not sure if those 3 months could be counted...maybe under "implied status" b.c you were applying for your PGWP, but i'm not totally sure about this.

Regarding the new CEC rule, so far we don't know when exactly it will be implemented. it could be January, or later

You say this is the "worst case scenario," what's the "best case?" Is your employer applying for an LMO for you?

No one will really know until the new rules are published (likely January). If, in the "worst case" you do have return home, you would still be able to apply if you are eligible under the new rules.

Thanks for your reply, I appreciate it. Yes, from September 2011 to November 2011 I worked on off campus work permit as I was under transition period from Off campus to Post graduate work permit. The letter of attendence, which i received from my school says, I graduated from School as of August 2011 having meet all program requirement successfully, since i was working full time with the company, i had to continue work on off campus work permit as i was waiting for post graduate work permit.

i just wanted to have share of thoughts on whether can i take my chances based on 10 months of experience on post graduate wp and 2 months on off campus, which also came after my graduation.

Thanks for your response, my employer is helping me in Saskatchewan immigration nominee program but the recent changes have made it more tougher and province immigration is also not giving anymore luxury and on the top of that it is taking too long to process application and rules here are now more or less same as ontario PNP, hence to take my chances only on SINP would be big gamble and so i am hoping that in worst case, i can't get my SINP done by december and have to return back home, i might take a risk or a chance to apply under CEC new rules, Do you think well prepared and detailed application in a requested manner might work out for me ?

But you didn't answer whether your employer was willing to apply for an LMO for you to extend your stay as a worker (you Could go from a PGWP to a closed Temporary Work Permit with a positive/neutral Labour Market Opinion).

When exactly(day, month) did you start working in December? For example, if you started working Dec 5th, 2011 it would be in your best interest to work until at least Dec 5th, 2012 to be on the safe side.

I believe he said that he didn't work on the month of May of 2012 so he would have to work until January of 2013

Hey Jes, My employer might not willing to engage in LMO process, they are helping me out by Saskatchewan Nominee program but looking at current timelines and structure, I don't expect to get things done before december 2012 and so, by worst case scenario, I mean in case if i am not being able extend/reniew my work permit after december and have to return back home, Can i apply as per new CEC class 1 year rule in skilled worker category by taking risk of counting those 3 months I worked on off campus work permit after my graduation ?

Hey Sen..Thanks for your comment, I worked from Septembe 2011 to November 2011 on off campus work permit, once i graduated from school in August 2011, while i was in transition period ( 1st september to 30th november 2011, when my off campus work permit expired) and from 1st december 2011 i kept working on my post graduate work permit.

Yes, Johnny is right, I did not work in between May 2012 month as I moved from Toronto to Regina and did not find skilled job in that month.

Only thing I wanted to know and have your suggestion is if I don't left with any other option once my post graduate work permit expires, Can I take a risk by applying under new CEC 1 year rule knowing that I worked 3 months on off campus work permit in that work experience ?

Can well prepared and well organized documents and application saying that i worked 3 months on off campus work permit after my graduation and explaining my situation in professional manner would work for me ? any suggestions !

The CEC guide clearly states that work experience on an off-campus work permit does not count, so the 3 months won't count. You also need to work until at least the end of January 2013 to have 1 year work experience. If you go home in December, how will you achieve this? Ask your employer about applying for a LMO and if they decline, find another employer willing to. You can also change your status to visitor(you can't work) and if you get a LMO then you can change status to worker again.

My current employer is willing to help me in SINP nominee program of Saskatchewan but the problem is they are very slow as a big company they have lot of other things to do as well, I am very scared of asking them same thing everyday....I have all documents ready for SINP nominee application with full time permanent job offer in NOC B category EXCEPT SINP job approval form for which my employer is yet to register with SINP and they are taking too much time...I have 2 months now before my work permit expires and I am very much stressed out ...My employer is not willing to engage in LMO process and so i have two options only either to wait for SINP application and pray for the best OR in bad circumstances i need to go back home in december once my work permit expires and then hope i can take a risk of apply under new CEC class in january 2013. but the problem is that in spite of having 2 hard fought years in canada, my struggle is not ending....
