Dear Folks

I am in Canada and fall under CEC category. While moving to Toronto, with SOWP option LMIA number was not required.

Now i have a question while submitting my express entry profile, can i select LMIA exempt option under the job offer section?

1. I am on open work permit,
2. same company intra-transfer
3. Fulltime job
4. completed one year of experience in Canada.
5. I have the employer letter ( roles & responsibilities, tenure, and Designation mentioned). LMIA number was not there on the employer letter.

Appreciate your thoughts & experience.

Short answer is no.

You do not qualify for the job offer points since you are on an open work permit with no emloyer named in the work permit. Your employer needs to get an approved LMIA if you want the 50 points.
 
no, for open work permit you need to have an LMIA to claim the job offer points in EE.On open work permit without LMIA ircc will not consider the job offer valid even if the offer letter is provided by employer.This could lead to rejection during eligibility stage.
 
I have a similar situation. We are applying with my wife as primary applicant. She worked as clinical fellow from 2021 in the same hospital but initially on SOWP. Now she got her closed work permit with LMIA exemption applied by the hospital. However, the job offer letter does not mention LMiA exemption although she has a closed work permit. I was wondering if we can just write an explanation letter mentioning the LMIA exemption number as attaching the closed work permit as additional document. Any suggest will be really helpful as we have to submit by March 13th.

There's always going to be some risk in switching employers before you get PR. If you want no risk, then wait until you have COPR / PR before you switch employers. If you are OK with some risk, then you can definitely switch now.

Appreciate your suggestion, Scylla. Another option is to apply for the closed work permit for another employer. But it takes time.
