Hi,

My intra company transfer (ICT) closed work permit is valid till 2018. My project is getting over in Canada and I have been told to go back to home country. I have applied for PR. It's been 1 month since I submitted my application.

What are the repercussions if I decide to resign and stay back in Canada.

1) Does the closed work permit get cancelled if I resign?.
2) Does the Temporary resident visa and visitor visa remain valid until 2018 or do we need to apply for fresh visitor visa?.
3) Can my wife apply for open work permit based on my closed WP, even though I'm no longer working?.
4) Is there a CIC email address to which I can sent these queries to?.

Appreciate your inputs.

Your Closed Work Permit is tagged to employer so if you resign it becomes invalid.

It is valid as long as you are working with Same employer and Client. You can try moving a different client/project with same employer and submit a client change letter to CIC

Yes but it based on your Closed WP, you should be ideally working here.

4) Is there a CIC email address to which I can sent these queries to?.

Yes, you can stay in Canada - but you will not be able to work if you resign. After you resign, If you want to work then you would need get Valid job offer from the new employer and then Employer have to get approved LMIA. You can then apply for new Closed WP with new employer.

1. Yes, the closed work permit will be invalid
2. Not sure if a visa could be conditioned, but it will still be valid since entry is up to the custom. So if they ask and your condition changes, you may not be granted entry in Canada.
3. Once approved, her permit is independent and will not be affect by change of your condition.

Since you already applied for PR, maybe you could change the condition of your work permit and make it open?

Mate I saw your post about BOWP but you have removed it now. OP has to meet below condition for BOWP, that is the reason I did not comment on BOWP. Point 2 is important.

Kindly have a look at the following 4 parameters for BOWP:

The foreign national is currently in Canada;
They have valid status on a WP that is due to expire within 4 months;
They have received a positive eligibility decision on their PR application under one of the Economic Class programs above; and
They have made application for an open WP.

Yeah, I thought the question was based on his permit expiring soon. And then I realized it's still valid till 2018...
Still worth a shot for changing condition tho, same idea as the BOWP, except holding a valid work permit already.
