CEC - Formula and Criteria for counting one year of Canadian Experience

Hi Folks,

As the title of my topic says, I am confused about how the Canadian experience duration is calculated? I did not find a clear formula to calculate the duration. Here's my experience details and I am expecting some expert would help clarify my questions.

1. 2010 March to 2011 July did an end to end ERP implementation for a Canadian O&G company - total duration was from home country, which means not being physically in Canada.
2. 2012 November to May 2013 on an ERP implementation for a Canadian O&G - total duration was in Alberta, which means physically in Canada. Was paid in US$ but filed for taxes in 2012 and 2013 in Alberta. Have my T4 also.
3. June 2014 till date - Employed with local company in Alberta, being paid in CAD but serving a US client.

What is the duration of my total Canadian experience as per CIC? Any tip would be appreciated.

For #3 it would depend where you are physically working. If you are physically located in the US - then you can't count this time towards CEC (even though you are being paid by a Canadian company). If you are physically located in Canada, then you are fine.

Assuming you worked full time (at least 30 hours per week ) IN CANADA, 1 year = 12 months =52 weeks. Exact start and end dates matter, count the weeks. "Reasonable" vacation (.e.g. two weeks) can be included in that, but more than that might not be counted.

SSARAF, first of thanks to you for putting in your reply so clearly. So it seems yours and my thought are same which means my Points 2 & 3 (I am physically located and paid in Canada though working for a US client) qualifies for CEC. As you rightly said by Jan 2015 I should qualify for CEC.

The surprising thing is that a qualified attorney told me that if I have not earned in CAD (I earned in US$) I will not qualify for that period. Which means Point 2 is disqualified. This is what seems very illogical to me. 2012 onwards I have paid tax in Canada, got my T4, got my CRA assessment notice and still not qualified? I have been told that the key is earning currency.

Would appreciate if you or anyone in this forum help me with your experience or opinion.

Hi there,

One thing I think you can do is to ask for a letter from your boss explaining the situation in the letter saying that your job is under NOC 0,A,B; you work in Canada and pay for your tax in Canada etc... Then I think you should be fine

Make sure as well that your future letter of reference in Jan 2015 detailed your salary/wages to match with what you have in T4s or NOAs. Also give it extra 2-3 weeks buffer, just to account any differences in experience that would be calculated by your VOs.

Sorry folks for coming back so late.

so, I applied through EE and received ITA under FSW. Clearly CIC did not consider me as a CEC because my experience was not continuos? very strange! It's not mentioned anywhere that 12 months of Canadian work experience should be "continuos". CIC and their rules :-X

Thanks @retwant for your wishes.

It's also the beginning of a lot of disappointments and difficult situations. Just keeping my mind open and fingers crossed :)
