hi clodaoc - could you clarify about the temp work - are you saying it was skill level C, or are you saying you put the wrong NOC code?

If it's the latter, if you're willing, could you post both NOC codes (the correct one and the one you wrote on the application) ?

Hi, yep i can clarify. So all the "temp" work i'm talking about was over the space of about 3 months when i initially landed in Canada 3 years ago. Just a few short term assignments to get some income while i looked for my job at BC Hydro (used code 1221 here).

1241 - Admin Assistant (i know this code is ok)
1411 - Word processor, filing clerk, office clerk
1422 - Data entry clerk,
1414 - Receptionist

The code 'C's that i used amount to 226.25 hours, so just over 6 weeks work.

One of my temp assignments which was for 86.75 hours (2.32 weeks) was based in a university and my position was administrative in nature, dealing with admissions to particular courses. Code 1221 could sort of be used here however besides dealing with the applications and assessing who got into the course and who didn't, i didn't hold any major responsibility or seniority in the department. As i said it was just a temping assignment and it was through a recruitment agency. Apart from that the jobs were office support in nature.

I'm pretty aware that i'm grasping at straws here. It just kills me to know if it is rejected because of something as stupid as this where as i could have just waited another month and submitted the exact same paperwork then i have just wasted 7 months doing absolutely nothing!! And....if i can't submit another application now i just have to wait until i'm rejected before i can send through another one containing the same info and coughing up another $550? :(

Honestly speaking, every time a member comes here and tells that after 8-9 months now their application is refused - its just literally nerve wracking. For some of us, its cool - we are in job, we have got WPs, we have got BOWPs..and every thing is cool. For some of us, you can't imagine how their life would be stuck in a limbo. They can't work. They can't go back. I'm not here to point score or start arguments, but please - before we suggest or give our opinion to some one, let's be sure that we are putting a correct info out there. If somebody got misguided by me, i seriously apologize and pls point that out to me and i will delete that info so that no one gets misguided.

Thanks for replying to that, InfoSeeker12! In JORGER defense, I do think that sentence in the guide was quite confusing.

Just to clear any confusion, since we already know what the new rules say (OP25-A), let's see what the old rules say (OP25, which can be found here: http://www.cic.gc.ca/english/resources/manuals/op/op25-eng.pdf):

"This chapter describes the processing of applications for permanent residence submitted by applicants in the Canadian Experience Class (CEC) received before January 2, 2013." (p. 5)

Hopefully that will settle this discussion.

So it sounds like they were NOC level C (for the most part). Unfortunately, there's no way to know if the VO with your case is going to cut you some slack or strictly apply the rules... chances are very good that it will be the latter, unfortunately.

You could request a withdrawal, but you can't get a refund for that application, so you might as well leave it in play. But there's no reason you can't submit another application now.

Oh totally Ondine. Of course Jorger didn't put anything wrong there, its just that guide is actually referring to the changes in application instructions and not about the CEC criterias specifically.

But anyways, i hope all the members will be clear on that note by now.

Hi Clodaoc,

I stopped responding to your messages - not being rude or anything, but i saw that Jes has started to take interest in your case. And well...Jes is Jes! This person definitely knows a lot more than me (and perhaps some of us) who babble here.

So you are definitely in safe hands. And I'd repeat what i suggested earlier - Prepare your docs again and apply again. This time you just have to prove 12 months of experience - but 100% in skills 0, A or B.

Hi - thanks for taking the time to advise on my situation, had i been more patient and applied in January i would be fine but of course i was too eager and this is the situation i am in now!

I will start preparing another application and submit as soon as i have my police certs.

Thanks for every once input to clarify that application received before 2 jan 2013 will be assessed on old 2 year experience stream ie 37.5 hrs per week 2 years experience in case of work permit. and on or after 2 jan 2013 will be effect the new rules @ 30 hrs per week.

once again thanks for the healthy debates guys
