CEC and work permit extension in Quebec

Hi,

I've applied from Quebec and do plan to leave it, but while my BOWP seems to be lost (canadavisa.com/canada-immigration-discussion-board/bowp-lost-is-that-possible-t297203.0.html) my current employer is going to extend my current work permit in Quebec for one more year. Please note that it's the company who is a primary applicant as I never was asked to put any signature on the docs or appoint a representative. According to CEC requirements I should not plan to live in Quebec, which would be the if I applied to PR to both CEC and Quebec provincial program, but in my case it's just a temporary work permit extension. Does anybody know if it's going to cause any issues with my CEC PR application?

Thank you in advance,
Regards.

No, it will not cause any problems. However, be advised that you will have to leave Quebec as soon as your PR under the CEC program gets approved. Do not try to land in Quebec. They might also ask you for supporting documents that prove that you will leave the province prior to issuing your PR. If you haven't found a job outside of the province or an apartment to stay, make sure to leave right at that point so that you can move, provide them with an address and ideally a job contract out of province within the given time.

Thanks for response, Marlee. Do you know about any official provisions on this case or know it from your own/smb else experience?

I have a co-worker who is in a similar situation. She applied under CEC but works in Montreal. She will have to leave once her PR gets approved (presumably September) and she is moving to Vancouver in July just to be safe and prevent any further queries.

There has also been another user in the same situation and this is what he/she got from CIC:

As expected, received the below email from CIC today. Now it is almost certain that it will be rejected. Any suggestions/ways to prevent this?

This refers to your application for permanent residence in Canada. Please note that your file is in process and will continue to be processed at the Case Processing Pilot-Ottawa (“CPP-O”) office. I am writing you this letter to express my serious concern(s) regarding your application.

You have been working and residing in Montreal, Quebec since your arrival in Canada in May 2010. As per R87.1(1), the Canadian experience class is prescribed as a class of persons who may become permanent residents on the basis of their ability to become economically established in Canada, their experience in Canada, and their intention to reside in a province other than the Province of Quebec. You demonstrate strong ties to the Province of Quebec given your employment history. For this reason, I am not satisfied you intend to reside outside the Province of Quebec. Therefore, I am not satisfied your meet the requirements of the program.

Therefore I am asking you to submit any additional information and/or documentation that would allay my concern(s). You have 60 days from the date of this letter to submit the additional information and/ or documentation to the above address.

Please ensure that you quote the file number indicated at the top of this letter on any information you submit. If you choose not to respond with additional information and/or documentation, or if your submission does not allay these concern(s), your application may be refused.

We look forward to receiving the additional information and/or documentation within 60 days.

Yours truly,

Thank you Marlee! That was a really good hint on what to expect. I hope they won't reject my app wihtout any preliminary investigation as I do have alot of proofs to provide and haveing 60 days is enough to break all ties with Quebec and get established outside it.

Don't worry. That won't happen. If they have doubts, you will certainly get a query first and then you have 60 days to provide them with all the proof you have. Everything is going to be fine! :)
